I don't think that is violating confidentiality. It is not like...

you would be publicly posting the e-mails, but they would be sent to an agency that routinely deals with these kinds of disputes and regularly sees confidential information as a necessary part of their operation. Any information your employer provides them would also likely have the confidentiality clause on it, so I don't think they could prevent you from using the same.

Thanks, But wait - doesn't that mean I'm violating one
I'm sure it's in there somewhere.
There were post on another board about test dictations violating HIPAA regs. sm
Some people seemed to think they were using actual dictations, with actual patient info, in their test dictations.  I would leave them alone, way alone.
That's why you sign a confidentiality
to this information?  I've had access to this information since I started MT in 1981.  I also have transcribed reports on lots of public figures, celebrities, professional sports players, radio and TV personalities, etc.  I have access to their phone numbers, birthdates, social security numbers and address as well as their diagnoses, etc.  What you see/hear/transcribe goes no further than YOU.  You are a part of the health care team.  The doctors and nurses have access to this information.  The unit clerks have access to it.  The coders and file clerks have access to it.  There are lots of people with access to the information.  They just all know it is confidential patient information and is to be used only in the peformance of their job.  If you were a criminal and used that information to steal the patient's identity, you would no longer have a job, nor would you EVER have a job in the medical field again.
Of course it is a breach of the confidentiality agreement.
But what can you do about it? Absolutely nothing. We have no way of knowing the identities of these individuals. There is no way to enforce it, especially when most of the MTs work from home. It would be a totally different scenario if two MTs work at the company and are overheard discussing matters that should not be discussed. All the MTSOs can do is to maintain our company standards and follow them to the letter, i.e. x amount per line based on x number years of experience and try not to deviate from it.
She might have had him sign a confidentiality agreement. Did you ask her about it?

Why did they send you a confidentiality agreement just to take the test?

Email and IP Address Confidentiality -- ALL READ

It is important that each reader and poster understand the safety of their information on MTStars:

Email Addresses

Email addresses should never be typed into a post in any way.  The email address you validate to have posting privileges is never given or sold to any individual, group, company or association.

You may receive emails to that address from others using the Reply By Email option on one of your posts.  If you receive an email through the MTStars board, it will provide the URL to the post it is referencing.  Your email address is still not exposed at this point.  The person sending an email does not see your email address but has simply filled in an online form to send you the email.  If you choose to reply to the email sent to you, then you have actively chosen to expose your email address to the person emailing you.

MTStars does not recommend that you respond to any unsolicited email unless you are certain of the validity of the sender.  Anyone can send you an email through the Reply By Email option on any post you make.  It will go to the email address you used to validate that post.

IP Addresses

Your IP address is private and confidential.  It is never given or sold to any individual, group, company or association.

Depending on the email agent you use, if you respond to an email sent to you (or if you send an email to someone outside of the MTStars board at any time), your IP address may be traceable through your email.

Can companies or individuals find out your identity?

Yes.  Not through exposure of your information (email or IP address) but through recognizing situations you describe or other information provided by you when you post.  It is deductive reasoning.  If YOU provide enough information, you may be effectively “signing” your post.  This is true on any board, whether open publicly or not.  Even private boards cannot guarantee who their membership really is.

Do companies and associations read MTStars?

Yes.  Anyone can read MTStars.  Information posted is searchable on the Internet.  Even a private board can be read by anyone who registers as a member.

Making claims that MTStars provides, gives, exposes or sells your email address or IP address is a libelous claim and will not be tolerated.

This is the confidentiality clause on email I receive

This email message may contain legally privileged and/or confidential information. If you are not the intended recipient(s), or the employee or agent responsible for the delivery of this message to the intended recipient(s), you are hereby notified that any disclosure, copying, distribution, or use of this email message is prohibited. If you have received this message in error, please notify the sender immediately by e-mail and delete this email message from your computer. Thank you.

The way I translate that whole paragraph is:
I am the intended recipient. The rest of the paragraph does not apply.

However, if I were NOT the intended recipient, THEN I am hereby notified regarding disclosure, copying, distribution, blah blah blah blah.

Go prove your case and get what is owed to you.

Good luck.
Not a single soul here works for CIT? Did you sign a confidentiality agreement or something?! :) nm
