I have read this article (you have to scroll down a little, but I have found it helpful in explaining some things regarding IC vs Employee.  Just wanted to share for anyone who is interested.

Can someone please tell me the difference between independent contractor and employee status?  I was employed for a company about 6 years ago where I was an independent contractor and they didnt take out federal taxes.  I then went to a company as an employee status where they did take out federal taxes out of my check?  As an independent contractor, do they all not take out federal taxes and can you request that they do if that is the case?  I have almost 10 years experience and have been applying for jobs left and right with no response and have only been answering ads for employee based work because of the federal taxes?  I can not understand why I am not getting any responses.  What am I doing wrong?

I just recently started working for MQ.  Everyone is getting me confused.  First, I am emailed about a rental fee.  I called and told them I was an employee.  I got my first paycheck and they only took out state and federal taxes.  So, I am still as confused as they are.  I left 3 messages for payroll and 3 emails.  No answer as of yet.  Are they supposed to take out all taxes if I am a full time employee?  They only took out state and federal. Does this make a statutory?

state, federal and Social Security. I didn't want to be botherered with the taxes and it was an option they could or I and I chose MQ to take the taxes.

I was wondering if anyone could tell me the companies who hire statutory employees? I would like the flexibility of an IC, but I would like the company to pay half the taxes for me. If you know how I could find out which companies work this way, please let me know! Thanks!!!

Statutory employee
By definition an independent contractor (IC) should not be told that he/she will work 8 hours or 2 hours straight on a schedule. You give them the schedule you prefer to work and they accept that or reject it. The operative word here is independent. Far too many companies try to not do the tax thing and still want control of the IC. The IRS does not like that!

Please, can someone tell me if there are transcription companies that offer remote MTs employee status w/medical benefits.  Is there such a thing as a Statutory Employee and what does this entitle us to?
They only offer SE - statutory employee
Since they don't offer benefits, you're not classified as FT or PT.

I know that being a statutory employee has some SS taxes taken out by the company, but does being a statutory employee mean a company can make you stick to a set schedule?
Congrats! You are a statutory employee, not an IC
They do take a portion of taxes out of every check. But since you don't have any further benefits you get the 24 hour turn around flexibility. If someone else covers your health insurance, it's the best of both world in my opinion. Hope this helps.

Therefore, you do not have to file self-employment tax, like an IC.  You are still not an employee per se, in that you set up your own schedule/make your own hours.  You tell them how many lines you will do in a day, and every 2 months, you submit a schedule, telling them which days you will work.  


You have to have your own PC.  You can rent a C-phone from them, and some of the accounts are going to wav files, and I think the company provides the wav pedal for you.

I had a hard time as a statutory employee, but
now that I am a regular employee and have to have a set schedule I am WAYYYYY more disciplined. I guess I actually needed that boss hanging over me (not literally, LOL) to make sure I work and make $$$$$. Best of luck to you.
Agree with poster below - MDI is statutory employee
There are no benefits.  It's basically the same as IC with the taxes taken out.  Did you think you were hired for employee status?  Don't mean to rain on your parade, but better double-check that.

I said it before, when MTs were first forced to go the employee route..it's all about control...same for statutory.  They have no right to dictate shifts/hours unless you're paid for your time by the hour.  In either, you only get what you produce, per production. You might think you're ahead with employee status because of benefits.  But what happens when you can't make your line count, even through no fault of your own?  The only square deal is IC status... you get what you pay for..no more, no less.  They don't pay for your time.. so they can't dictate a schedule.  What other industry would require a certain amount of your time and not pay for your time?  It would be different if they were to guarantee a certain wage per hour/day, etc... but they can't even guarantee there will even be any work.


Statutory Employee: What services hire SEs?
I have enjoyed the flexibility and tax part of being an SE with MDI-MD, but it seems very difficult to find any service who will hire SE.  I see IC or FT or PT, but not SE.  Could someone give me some leads?  I searched the archives, not much current info. there...thanks!!

Good luck and I'm glad you're giving MQ a chance.  I think you will be pleasantly suprised. I know I was.  I was kind of disappointed when they called me back, but I really needed a job, so I took it, and four years later, I'm very happy! Good luck to ya!

You report wages and expenses as a statutory employee on schedule C.
I don't know how the company is these days, but when I was employed by them, there were some very rude people who worked in the office. I suspect since they were so high up, they're still there.

Different take on the meaning of this
If your testing did not qualify you did it ever occur to you that you did too well? Perhaps you did ace the test as you believe (I do not doubt your feelings at all), but that would mean they would have to give you top dollar, and they don't want to hire someone like that right now, or ever. Don't know this company, but I have been through this. But I go one step further. I always am flexible with my cpl rate in the cover letter, and so when I ace a test like you did they do get back to me. But, I have been offered 6.5 to 7 c/line, no kidding. Then, I say no. What do they think flexible means? Stupid! Yes. They think I am stupid so offer me a job. They know you are not stupid because you aced the test, so they say you are not qualified for their low pay scale. That is just IMHO. Sorry to take the opposite position from the other poster who says you are not as good as you think. Since this person does not know you or your skills, I think that comment may be way off base. So, don't let these things ruin your day. Count it as a blessing and find a decent place who will appreciate you. IMHO. Good luck!
A contractor is a contractor

My brother is a painting contractor, doing primarily office/industrial jobs.  When he bids on a project the buyer can make certain reasonable conditions: You can start any day after May 15 and we want you finished by our big open house June 1.  You have to work after business hours, i.e., from 6 p.m. to 7 a.m. or weekends.  We want high-quality washable semi-gloss paint.  Don't splatter paint on the floor, furniture or woodwork; you are responsible for damages.


He tells them what he charges.  If that works for both parties and everyone's needs can be met, then they sign the contract. 


What the buyer cannot do is specify:  Your crew will consist of 5 men.  You will clock in from 6:01 p.m. to 6:59 a.m. every day from May 16 through May 31.  You must use a 2 boar bristle brush and 12 rollers with 1/2 nap.  You must mask off all woodwork and use 12' x 12' vinyl drop cloths.  (It is understood that you are hiring a professional and he already knows how to do the job.) You will use 100 galons of  XYZ brand paint which you can only buy from my cousin Vinnie.


Only the most general control can be exercised by the company hiring the contractor.  Obviously the location where this type of work will be done is fixed.  The date and time parameters are much less specifc.  The methods and materials are completely up to the contractor.

I hope I'm on the right board here.  Can someone tell me the perks of being an IC?  Is it just that you can set your own hours?  What does being an IC consist of?  Do you pay all your own taxes, SocSec, etc?  I've always been an employee and exploring new opportunities, but from what I see being an IC looks like a pain, with no benefits!! Thanks!

Can any of you IC's give me some info on what it is like to be an IC? I know you get paid by the line, but how many lines do you generally average a day/hour? Is there always a lot of work to keep you busy? Also, do you get to choose what hours you want to work instead of having set hours like you do as an employee? I just got hired by Terra Nova and would love any feedback on them as well. Thanks!

Ah, but you miss my meaning.
If she does not know that a lot is two separate words, I can only imagine the other kinds of errors that she makes.  That is so very basic.  I am not jealous of someone who does not know that a lot is two separate words.  I am not QA and I don't work for TT and I am not policing anything.  I am just really, really tired of the seeing ALOT and other inexcusable errors from people as they are bragging about their awesome quality-oriented companies that hired them.  I'm sure I'm not the only one who is tired of it.

I need some help deciding on whether to take an independent contractor position. I was just offered 0.08/line being an independent contractor. Is this typical pay for an independent contractor position? I currently make that as an employee. How does the paying into Social Security work? Any feedback on employee position versus independent contractor position would be greatly appreciated.The good thing about this job is no set schedule. The paying taxes, getting own insurance, and paying into Social Security is the things that I am worried about. Any info would be greatly appreciated!

but they DID lie. They initially told me that typing was not required. Just as they will review what I type, they could allow me to QA and review what I have QA'd. Very simple.

Whatever their reasons are for requiring this - they should be honest and tell the folks to whom they make an offer that typing is required.

They hired me as an independent contractor, and I was told that during my interview.
I worked for them through a contractor.
And I loved it, loved the platform and they were very nice. Unfortunately when I tested for them a few months ago I got 96% and they require 98% DRATS! I will try again though!

In the simplest of terms ... if you are looking for someone to hire you, then you're not independent contractor. However, if you see yourself as a one-person MTSO, and you conduct yourself in that fashion, then you are an IC.

Thank You all and I wasn't meaning ESL accent...
I was meaning ESL who can't speak English, but make up their own form of Americanese language (broken up/half-English)i.e. physical thrappy for physical therapy and palawong is echocardiogram, therefore the whole report is a big fat blank because I still couldn't figure out how palawong sounded echocardiogram. Thank MT@diskriter, I will give Diskriter a try and I hope to get 2 accounts and stay on those 2 accounts besides rotating accounts 4 or 5 times a week. The downtime sounds like some good insurance. Last job work 2 hours and had no work so I would sit and baby-sit the computer catching job here and there for about 19 hours for 600 lines due to no work and no pay. Thanks again all.
IC status (independent contractor) sm

is just like it sounds.  You are contracting work independently from the company.  You pay all your own taxes including the other half of your SS which is called self-employment tax.  They cannot set your hours, but most places like to know an approximate time when you will be working.  I was IC for MQ for years and then they went to SE status where they had a little more control and then this.


Also, because you are IC you get no benefits whatsoever.  You are self-employed.  So if benefits are what you need, this is not for you.  But, if you need the flexibility it may work for you.  It worked for me for years.  Supported a family on it.  It was much better than what they have now.  In my case, I could actually pay my own insurance and disability insurance and still come out better. It just depends on the production you are able to do.  If you have any more questions, feel free to e-mail me.
