Retaliatory firing for contact with government oversight agency is illegal in all cases (Whistleblower's laws). It is hard, however, to prove retaliation because company can fire for breech of policy (working overtime when not approved, etc), can railroad you until you quit or they pick up enough nitpicky things to justify termination, or in most states for no reason at all (shaky if you've been to labor board). Whether reported or not, it opens a whole can of worms, and not everybody is going to be happy with the consequences (just look at the MQ saga). IMO solely, if OT is not specifically approved, don't work it. If you want to work it and not put it on your time, feel free (but that is fraudulent records if you're caught - again grounds for termination if anybody cares, which they usually won't unless under scrutiny by oversight agency). If you ask for and get approval beforehand, everybody's happy.

If you already were past the application stage then hopefully you already had an idea about what working at DRC would be like.

All of the posts yesterday confirmed that Acusis had bought DRC, so that comment about validating it made no sense to me.

Finally, maybe it's just me, but I've always considered accepting a job based on my interaction with the recruiter and/or employer and not the unknown/unnamed MTs of said company that I have absolutely no knowledge or interaction with. (Unless DRC's recruiter is now offering up current employee reference calls for your pleasure.)

Good luck at your second choice. I am staying with DRC/Acusis and I frankly could care less which MTs decide not to.

I don't work for this company, never have. Yet it seems that people are always saying things that are not true about this company and causing a HUGE stink on this board. I can imagine that this has to be painful for the owner, as I have seen her posts in the past. Please don't do this.
These conflicting statements may be due to their
hiring seasoned MTs. The person interested would need to ask them directly.

Proof of statements made
Can this be backed up by some proof?  There are a lot of good companies out there and great MTs.  It would be a shame if you prevented them from an awesome partnership from these statements that may or may not be true.
I am QUALIFIED to make my statements because....

I worked with these people for years and saw how they treat others.   It means absolutely nothing to people in the managment of SPI to fire people or lay them off or just take your work and send it to India or Manila.   Don't think for one second that your job is safe.    They are all about numbers...Its a numbers game...meaning revenues.


The Philippine Telecommunication company did not get to be a company worth over $100 billion US dollars  by paying labor to US employees.   They know that by taking US jobs and sending them to India or Manila will increase their profit margins 25-35% minimally.    Don't think for one second they will not do this.  


The Indian companies are much better than they were.   The Manila location has finally gotten it right.   They will be able to transition your jobs smoothly without compromising quality or TAT.   THAT'S FRIGHTENING TO SAY BUT TRUE!


They have also geared themselves with the strongest voice recognition product on the market.   


So, let's take a look at the overall picture:


1.   People resources available offshore.  YES...thousands.


2.   Ability to transition and carry out smoothly.....YES


3.   Voice recognition geared to take over.....YES


4.   Qualified editors in Manila........YES


5.   Production MTs in India......YES


6.   Large hospital organizations not afraid to offshore......YES


I dont know guys....what else does it take to paint the picture for you.    You are all smart people....figure it out!

I wanted to speak to some of your statements
When you say people keep things to themselves, there is basically nothing to keep. We were told when we first started to use the mouse (believe it or not but prior to VR I had never used a mouse!). I got used to that and then when outsourced was told to use the so called hot keys. I am now 66, taught myself to type around age 11 or 12 and I did not want to retrain to use keys when I thought possibly could just slow me down so I do not use the hot keys. My company said people could get more lines using them. I cannot get any more lines than the audio will let me go and I have that to fast forward most of the time so the hot keys are of no use as far as I am concerned. There is absolutely nothing more that I do. I read fast, correct mistakes, spell check and never read back over a report. If you call that any tips or tricks, well then there they are but basically the same I have done for straight typing all these many years. Oh, as far as the preferential treatment, oh, lordy I wish I could get that, especially on Saturdays when it seems like all the ESLs in the world are dictating on my end. We are not allowed to cherry pick nor X out work that we might not like to do. Ours is first in, first out.

There is a lot of work out there with Keystrokes and others. MQ is losing accounts, and the other MTSOs are getting them. I am sure that they want to see quality and limit volume the first few days. I would if it were my company.

TSSC has only ever given 5-6 voice files to test. ONE and only 1 of the files is an ESL. You obviously have no clue what you are talkinga bout.

There was a lot of talk about how much work there was going to be with the new accounts, and evidently it was all just talk.  They are still playing the same games they have always played.  I wonder how many transcriptionists they actually have to cover all the large amount of lines that supposedly they were going to have?    They will eventually run out of transcriptionists to hire who will stay there with no work.

I have been with KS for almost 3 years now and they are, by far, the most caring, employee-oriented company I have ever worked for, and I have worked for many MTSOs over the years. If you are dedicated, dependable, and a hard worker, they will bend over backwards for you. I don't know where you got the idea that they only care about productivity. If you have problems, you need to contact one of the HIM managers or HR. They are all very, very nice people. Also, the CEO is one of the most caring people I have ever had the pleasure of knowing.

They did not keep only a handful of ICs to cover only what India cannot. Why would you spout such stuff without having facts at hand?

Also, CBAY is an American company with a subsidiary also in India (CBAY-India).

Their pay is on par with what most companies are paying. Payment is always on time. They are no longer doing employees, just IC status.

There are three people who do the training, and it is very thorough. How would you know anything about the owner? First of all, it is they not she. Secondly, I have worked at KS for 3 years and have never had any contact with either of them.

I am training to be a lead transcriptionist, so I have talked to a lot of managers, other leads and transcriptionists. All are very busy, and the accounts are not overstaffed. Every one of the more than 20 people I have been in contact with are very happy.

There have been no accounts lost in the past several years. If you were really an employee, you would know that no one has pulled an account and that there are new accounts constantly.

Broken promises? Very vague, don't you think? The employee book spells everything out. There are no secrets.

Either they let you go for one reason or another and your are bitter or you were never hired.

I think that Keystrokes is the most improved company I have ever seen discussed here or on other boards. They did have problems when they started but those are in the past. Current employees are either happy or being worked with to make them happy.

I am looking forward to being a lead and to staying with Keystrokes as long as they will have me.

Transcend false recruiting/low work
I was hired two weeks ago to do Cardiology, but hardly any Cardiology. I am stuck voice-editing the leftover clinic notes!! Potential Transcend employees, beware!! Recruiters will say anything to snare you.

I have been with KS for 3 years. I am treated fairly. I was also the lead for the person who is named as the person putting in the lawsuit. That person was fired for quality issues and is obviously trying to get even with the company.

Lawsuits can be filed. Filing one or having one out there does not mean that the company is guilty. If that was the case, there would be no reason for a case to be filed; you could basically just send a company a bill for whatever you want.

Many hospitals and clinics do a 100% complete outsource of one or more departments. The dumping and overflow could very well be at a company level. How do I know? I am a Team Lead at a big company and we do 100% of the work for more than 50 facilities.
Overhiring and giving new-hires false impressions that
they'll be able to make a decent day's pay is scamming too, cupcake.

Keystrokes is hiring and has many openings. The ER account I am on needs 2 or 3 more people, the B4 account my SIL is on is short-handed and they are hiring like crazy because of new accounts.

If you do not have enough work, contact your manager or go above her/his head. There is plenty of work there.

I also know for a fact that they are hiring for orthopedics due to a large new account because they sent an email asking if anyone knew anyone who was looking for full-time ortho work.

They do not overhire. Quite the opposite, actually. We are always asked to work extra. I know they are looking to balance this out but will not hurt current employees by overhiring.
It may be harsh, but it is true. Too many people come into transcription with false sm
expectations. They expect to get paid to stay home, watch their kids, work when they want, make a fortune after 6 months of correspondence courses.

It takes more than that to be a good MT and a heck of a lot more than that to be a great MT.

With this economy, it would pay to fine-tune skills, work on typing speed, learn new specialties. The best will survive and I intend to stay one of the best.

Not everyone is good at everything.
Ok - here ya go. I went from making $1800 per pay period to making just under $900.
Is that significant enough for you? Believe us, we are not just being negative with a grudge or anything like that. This is real! A month later, I was gone from there fast!

If you are an employee and do not meet the exemption requirements by the Dept. of Labor, they have to pay you OT if you have to report your hours. If you are salary this does not apply because you are exempt. But if you work more than 40 hours a week as an employee of any company, they are required to pay you OT at at least 1.5 your regular rate.

That's right. If they pay you on production, then you should be able to actually see it for yourself, not go by what they say. They refuse, because they know what they're up to, and I agree that if it is illegal, it should be ABSOLUTELY ILLEGAL.
There was nothing illegal about it
They were telling me that they were letting me go - had given all my doctors to other MTs over a time period. So, when they emailed me - I just called the unemployment office, since they didn't need me any longer and filed. The particulars had to be hashed out between the state and KS - not me. I then went to work as an IC - searched for employment every week as required - and filed as was required. There is nothing illegal about it - but in the transcription field, there are many more IC jobs than employee jobs, thus the difficult job search. I am happy where I am now and - and I think KS might have learned a lesson - but somehow I doubt it.

yes it is illegal! They have set the sm
requirements for the job. The requirements they have set makes that an employee job and not an IC. Check out the IRS regulations. It says, you MUST, you MUST, please do not apply if you can't work these hours, etc. I take exception to the part especially where she says do not apply if you want a higher wage, etc. This kind of stuff is why the MT profession is in the mess its in.

I am sure she will get somebody who really needs a job but they are getting a raw deal and this kind of stuff perpetrates more of the same!!!!!!!!!

It is clearly not an IC position.  According to the IRS http://www.irs.gov/newsroom/article/0,,id=173423,00.html


If you have the right to control or direct not only what is to be done but also how it is to be done then your workers are most likely employees.  If you can direct or control only the result of the work done, and not the means and methods of accomplishing the result, then your workers are probably independent contractors.  


This falls under one of the three broad guidelines that are used to determine Employee, IC or SE. 


According to Publication 1779,


If you receive extensive instructions on how work is to be done, this suggests you are an employee.  Instructions can cover a wide range of topics, for example:


- How, when, or where to do the work.


According to Publication 15-A,


Generally, a worker who performs services for you is your employee if you have the right to control what will be done and how it will be done.


It goes on to state that if that employer/employee relationship exists, it really doesn't matter if you call it an Independent Contractor position or not.  The withholding must still be withheld.


If that prospective employer is advertising the position as an IC with no intention to withhold any kind of taxes, the way she has phrased the ad, saying that you must work certain days and certain times, she is breaking the law.

They can give you a transcription test that will accomplish the same thing. This is nothing more than underhanded age discrimination. No hearing has nothing to do with age, so they should just give you a transcription test and leave it at that. If you can't hear well, you are not going to do well on the test anyway.

These companies hire MTs who don't know what they are doing all the time. New folks coming out of school with really no training and they produce a really bad document and that has nothing to do with their hearing..

Im telling you this hearing test thing is just a subtle age discrimination thing.
Asking illegal questions
No, they cannot ask what they want to. You imagine incorrectly. One should never put down one's DOB until s/he has an offer, or give a SSN until the offer is made. Similarly, they cannot ask questions regarding health and disability until they have made an actual offer. (Cf: Americans with Disabilities Act of 1990), so no, they CANNOT ask whatever they want--or if they do, you have a cause of action with the EOC.

there are a lot of unpaid internships available for other things to learn how to do the job, why not mt'ing.

then she needs to hire an employee, not an IC. I don't understand why people don't report these companies.
