Sudden change in 1099 status?

why would a company after YEARS of having IC's suddenly push everyone into an employee status?  Does this have anything to do with trying to make the company less likely to be unionized???  Or is there something else entirely going on that Im missing all the way around?

I have been down that road before and quickly went to IC. It all depends on which company you work for. I worked for a company that I had been with for quite some time, changed my work hours to four hours a day and I was told that I could not get up to get a drink, use the restroom, etc. I then quit and went IC.
When is an SE allowed to change to employee (full-time) status?

Is it 11/01/2005 ?????

Why, though all of a sudden do these posts pop up?
I was thinking about it last night and since this is an anon board, I wonder if sometimes negative posts about companies which pop up out of nowhere come from other recruiters to cut down the competition of labor. Right now E-Trans Plus has a good deal, a good sign on bonus. After doing a lot of research I have heard nothing but positive. Now, suddenly these bad posts show up. Seems fishy, I think. It isn't like the other companies which have a stream of good/bad, etcetera. This is popping up out of nowhere, and it looks like I don't trust it. Therefore, I will remain confident in my research, and the fact that so far in the hiring process they have been nothing but open with me. It has also been obvious that if you do less lines, you get less pay, but that would be if you do not meet production. If you are not provided enough work, I would say you would communicate this with your supervisor before you got busted down on lines. Or if your lines seemed to be getting slow to type, and take too long you would address that too. This is why I tend to believe Amanda, because she has been consistent whereas these new posts seem to be coming out of nowhere. That is my 2c.
Exactly. Why the sudden push to VR?

Unless the company is in financial trouble.  We never know because they never tell us anything.  This is the only place we can ever find out information. 


Whatever it is, I suspect it is time to move on...

it has disappeared .... I have to choose my words carefully, but I think the Administrator took it off the board because they were posting a job on the company board. The administrator does not let companies that offshore post for jobs - AND I PRAISE THEM FOR THAT!!!!

You can file without a 1099 -- as long as you have invoices, etc. that you sent them or copies of checks that they paid, you just report that amount to the IRS.  You don't send in copies of the 1099 with your taxes you just report the income.  Sometimes companies do not send out 1099 and figure it is up to the IC's to keep track of and report their income.  But be sure you have copies of all invoices or billings to the company to verify what you got paid.   That is why, when an IC you should invoice or bill out what your services to the company so that YOU have a record of what you did for the company.

They do not have to send you a 1099 for what they did NOT pay you, However,
you still need to claim what you received regardless if they send you a 1099 or not and pay your taxes accordingly.  I would report them to the IRS in either case, because I am sure you have tried to receive your past compensation without much success.
Anyone rec'd 1099 from Sten-Tel yet?

You'll get a 1099...

As a first-time IC, you may want to get some tax preparation help because you should have some write-offs that will most likely save you money.


1099 versus W2
An IC receives a 1099. You will see your total earnings under the section called Non-employee Compensation.

I totally agree with the other poster who said you should see a tax specialist, and I don't mean H&R Block. Ask friends and family who they would recommend. Don't just choose someone out of the phone book.

I'm also recommending that you get into the habit of deducting the money to pay your taxes with every single check you receive, unless you're really good with leaving your money alone (no matter what) and can pay your taxes quarterly. Also, a lot of people have different recommendations on how much you should set aside for your taxes. It can be anywhere from 20% to 30%, depending upon where you live. Discuss this with your tax specialist.

Just as said above, when I didn't receive it my accountant just told me to get my own information together and then send the employer a letter telling them that this is how much I earned, this is how much I'm going to claim. I guess I was just letting the OP know that I knew the feeling of not getting a 1099.

To the other poster above, I did get out of there as soon as I could. It was a local MTSO and at that point I was new and even now I didn't want to work for the Nationals so I stayed. The pay was good and as an IC I made my own hours. The only problem basically was the 1099 situation.

Isn't the amount $600.00? If you make that amount or more then you must be sent a 1099 form? I do have records of all of my earnings that I made last year. I made a little over $3,000.00 with this company. It was not that much, but enough to report in.
Agree..with IC status, equip. is your responsibility; employee status - you should SM
not have to pay out-of-pocket for use of their equipment. I would never work employee status for a company who required me to purchase or lease their equipment. The only thing I would find acceptable is to have a small security deposit taken out of paycheck when starting with a company. This will protect the company from those few who might abuse the equipment.

I am caught between a rock and a hard place and figure this is the place to get the best advice from those in the know.  I have been an IC for the past 5 years and love the flexibility but was interested in a job with benefits.  I started a new job about a month ago with good pay (2 lph more than I was making) and benefits......very happy with company but as an employee, obviously have a schedule.  I am working both jobs currently and starting to burn out.  On the new job, I am struggling to get the 1200 lines per day required but on my old.... I can easily get 150-400 lph depending on the dictator but again, it is IC and less lph than the new job.  Obviously, the platform is different and not paid for template headers/footers wheras the old one, I am paid for those.  Now to my question.  Is it just me?  Is it because I really enjoyed the freedom of ic status and therfore seem to be struggling?   Anyone else experienced this before?  Tempted to go back told job and lose benefits/more pay because in the end, maybe it works out be the same pay because of amount of time I spend getting the job done?   Not sure if this makes sense but hoping you can all offer some advice!!  TIA


Dont count on it. We got transferred to Amherst and all of a sudden tons of backups on the accounts
and no work.
Has anyone who worked for CorTmedical in 2006 gotten their 1099 yet?
I know that a lot of us were burned last year by this company.  I am wondering if they are going to at least send the 1099 for what they should have paid us.  I am wondering if they do not send it, how am I going to claim what they did not pay me as a loss?  Thanks to all, hope everyone has found something better since that disaster.

Am I not correct that employeers are supposed to send out 1099 forms by the 31st of January?  I quit a company back in May of 2007 and I still have not yet received a form.  I guess I should contact these people?  You would think they would have sent it to me by now!  It's frustrating having to contact old employers because you really do not want to have to be bothered by them anymore!

As long as we accept the exploitation that this MT profession has reduced us to, it will keep going on.  The top of this is the outsourcing.... well, get your legislators involved....better yet, the MEDIA.  How many patients know their private medical information is being outsourced to halfway around the world? The squeeky wheel gets the grease.  Do the patients know that their info won't be sold by some unscrupulous MT (halfway around the globe) to insurance companies, etc., making all this Medical records privacy a joke. It's not just our T-shirts being made in other countries; it's our most personal, private medical information, of which the public is not being made aware of.  Not to speak of undercutting out profession to the bare bone.  Granted, most US MTs are willing to work below market wage just to have a job, especially in economically-deprived areas, where outside jobs are scarce, and kids need to be fed and mortgages need to be paid.  MTSOs know this.  I'll bet they'll be the first to lobby against any action against outsourcing.  (Wouldn't you be...if you got people to work for pennies while you're raking in the big $$$'s ?  Still, notwithstanding the outsourcing problem, we're still going along with all the BS...working for pennies, whatever the client wants, he gets... ever notice how all of the MTSO flak seems to be re. unpaid work...mostly, demographic issues we're not even paid for... bec. It has to be done.. Part of the job... The client put the wrong info but we have to correct it...all unpaid work.  Just give me a job with nothing but straight transcription, w/o the unpaid/demo. flak..I'll take it even at the present, absurd pennies-per-line state of the profession.
CorTmedical MTs; Have any of you gotten your 1099 from CorTmedical for last year?

I just love these posters..gonna be a big change..well, what?  Dont post something like that and not explain.  It only causes anxiety and speculation in an already scarey field, with outsourcing, etc.  Big change, well, come on now..what is gonna be the big change and where did you get your information from?
Well, then maybe that should change.
Maybe they, too, should be paid based on what they produce, with a little bonus if the person stays a year.
Sometimes you just get in a rut and need a change. Sometimes you just
get burn-out in general and think it is the company/account.  I've left a position before because I thought the grass was greener, but it wasn't.  Had to learn new platform, new software program, new dictators with various new accents to figure out, new way to count lines, etc.   Even if the pay was a bit better I still figured I lost money and the grass wasn't greener.   No company is perfect, but there are some very good companies out there, but there can still be intermittent issues with any company.  Sometimes talking with management might resolve issues, sometimes taking a break will refresh you and make you see things in a different light.  List pros/cons of present account and compare that what a different company has to offer.  You may realize you are better off where you are and if not you can feel comfortable that you're making a change that really will be better for you.   If you do decide to leave current account just don't burn any bridges so you leave with the possibility of being able to return if new account/company doesn't work out.

the subject somewhat.  Gastric bypass and lap banding scare me to death!  I personally know of five people who underwent the procedures, and all had complications, one being death.  They all had excellent surgeons, one being my surgeon.  Everyone responds differently I know, and that is the problem.  It is too much of a gamble for me.

Are we all in the same boat?  I work for the largest national in the country and am hoping to hear about another position with another company tomorrow or Wednesday.  Many of us have been MTs for years and make less now than then we started.  We get thrown into the national cesspool and may get 20 different states in 20 different reports.  Impossible to make a good line count this way.  I'm slow to change and always fearful, but I'm really at the end of my rope.  Anyone want to add to this conversation, please feel free.  Happy New Year everyone!  May 2008 bring us more MONEY and more CONTENTMENT!!

well just talked to Vonage and everything was fine until they tried to transfer my line. Said I have to discontinue DSL through ATT for ATT to allow it, then vonage can transfer it...
So I will change to time warner for cable and then get the adapter from vonage. Yes it is a lot cheaper, but have to work out all the transfers.

It was a great benefit for me being an IC because I would work and get big paychecks and being a single mom, I would get the child credits and the earned income tax credits, and I would actually get money back, quite a bit.


But now that that is not going to happen anymore, I want some PTO and all those nice benefits!!!  Im just ready for a change...


Which companies actually hire employees and offer PTO, etc.?

employee handbook?  I briefly read it this morning and it seems that it boils down to **you owe us this, this and that and we don't owe you anything**.
That will all change.

I've been in the business 20 years too.  I worked for Transcend for 4 years and my honeymoon period with them lasted about 7 months.  Once the honeymoon was over, it was one of the worst job experiences I have ever had.

your mind if you were the sole bread winner as a big majority of MTs are. You wouldn't care about weekends at that point. You do what you have to do to support your family.

You can say what you want, but you have some off as self-righteous and definitely a slap in the face to all of us hard-working full-time MTs

What you are not getting is the change.
If you've always been used to it, fine...you have worked it out with the mortgage company, car payment, insurance, etc. You've got auto payment set up for your internet or your phone bill. So all those things have to be realigned. That will take some time to readjust both the inflow of money and the getting the autopayments changed.

And, some of you folks really don't seem to have any feeling for those that literally go paycheck to paycheck. I work two jobs. The only time I can take any length of time away from my desk is on Saturday evening and Sundays. Which works out great if I'm getting paid on Fridays. Not so good when it's falling through the week....so you're waiting extra days waiting for payday anyway and then you've got to wait longer before you can get out and do anything with it.

I'm glad your life is so stable that that waiting three extra 3 days doesn't impact you in any way. But having been there myself, and still almost there, I can certainly expend a little sympathy and try to understand how it might be problematic for someone else.
