Contract [2008-07-31]
There are contracts that are signed by clients and MQ, and again, I know for a fact many many clients will specifically state NO OVERSEAS WORK or the contract is broken immediately. A conscientious client will know when work is sent overseas. I worked for an MT service that tried to sneak a small percentage of work overseas and within less than two months the client found out and up and left that service immediately and that client is now with MQ which I followed. I was told that MQ would dare not try to send this client's work overseas as it is a big account. Another fact is that some doctors will absolutely positively not work for a facility that sends work overseas or will quit if the facility decides to do so. So some of you guys think you know what your are talking about when you do not. A lot of hearsay on this board.
Nope. MQ got us again. We all signed the At-Will contract a few years ago.nm [2008-07-29]

I had sent my employee handbook to the law office. I was unable to locate my contract though. [2008-07-17]
I did have every pay stub issued (I am a fanatic pay stub saver).
I wonder why they would keep us in the dark. It is, at best, inconsiderate, at worst, unprofessional.
Why are MTs regarded as insignificant, out of sight, out of mind? Because we are apt to see a doctor making an error in patient care?
It is obvious there are those who think we are paid more than we are worth. Typing sentences over and over again, they think. I try to tell them, it isn't that part that is hard, it is sitting in place for 8 hours and do nothing but type what is being said, without interaction with any others at all. It is hard on one's health to do this job. I suppose it hurts because part of the reason why I enjoyed it when I began MT 30 years ago is because the doctors fascinated me, so intelligent and articulate, so deserving of my respect and admiration for having dedicated so many years to acquire an education, in a field where lives were on the line on a regular basis.
Are we that obnoxious? lol
MQ could be sued for breech of contract [2008-06-04]

Forget tax cuts; how about PENALTIES. nm [2008-05-29]

MT does pay big penalties when they are out of contract [2008-05-09]
so they probably try to plan on having # people doing # lines. If you don't work your schedule or meet your line count, you are conceivably costing them money. Scary indeed.
All institutions charge penalties for work out of turnaround [2008-05-09]
don't know about the other case, but 25K is NOTHING to them. They certainly do not want to lose clients who pay the bills; they can afford to lose MTs.
Contract or not, is there not a clause in them [2008-04-03]
that states that the quality is a condition of the contract? I don't understand why a contract cannot be broken if the work is subpar.
No one made you wait. There were no penalties [2007-11-26]
So no. They didn't and don't owe for you deciding to wait.
and if MQ were truly about quality, they'd refuse to take a contract [2007-10-08]
that does not have a clause that says, after a physician has 10 send-backs for
unintelligible dictation, MQ will not be be responsible for that physician's dictation.
That's where quality would start. If the HONEST desire for quality would override the GREED factor, then I'd be impressed by MQ.
But right now all they have done is try to make the MT do something even a fortune teller with a crystal ball can't do -- and if the MT can't do the impossible -- she/he gets her pay cut. Nice, huh! It's MQ taking a chance -- they figure they'd rather get the little bit more $$ from the hospital while they make us sweat out here, then to up front tell the hospital they won't accept dictation from problem dictators.
Again, bad dictation should not be the responsibility of the MT.
We come into this job knowing our jobs.
We type fast. We spell fantastic. We know medical terms. We know drug names. We know disease names. We know the English language backwards and forwards. We know a good bit about computers even.
We know our job.
It's the physicians who don't know theirs. And we somehow got tagged with the responsibility of making them look good, and at the same time we are supposed to be these little goody 2-shoes who are supposed to worry our hearts out for the pt care. WELL, NO. We have our hands tied behind our backs for one thing. We have nobody to tell our problems to with this company. We get no solid answers from the head office -- never have. There is no standardization so we know anything. And here we are wandering around MTStars for goodness sakes -- why doesn't MQ have a board for us to ask questions on so we'd all be on the same page? Most MTs don't even know about MTStars -- they are really in a mell of a hess. I didn't find this place until I was with MQ quite a while. Nobody at MQ tells you about MTStars even.
We are isolated. We are ill informed about most things and when it does come its usally by the grapevine and maybe half right.
No, I just don't have the luxury of caring. Business men have taken that ability awaywhile they pursue their profit margin....and I'm refusing to swim upstream anymore. ..
I was told a month before their contract expired (nm) [2007-07-05]

Didn't we sign a contract to prevent this? [2007-07-05]
Is it null and void if the facility quits MQ first? I'm kicking myself if it is.
Wrong. Hospitals I contract with have invested [2007-06-22]
that it's not working for them. Sure, a hospital might have a contract with MQ but it's not going to last forever. When it's up, the hospital can do whatever it likes. And don't think they don't have the money to do it.

What happens if you breach the contract? [2006-11-23]
Can Medquist sue if you go with another service? Wondering why you would be required to remain in a contract if the quality is so poor.
Hopefully they didn't contract to have all of it done by the offshore *area*. [2006-11-11]

Regarding the lawsuit and contract. [2006-09-30]
If you happen to have been a YOG MT when MQ bought it out, do you recall our receiving an e-mail stating that MQ would continue us working under the contract issued by YOG?
I was contacted by paralegal regarding permission to use my name when approaching MQ to obtain my contract.
However, it just occured to me that I was working under YOG when I signed the contract. Is anyone out there who is in a similar situation?
Thank you.
So was every legal contract they ever sent me to sign! [2006-07-22]
If you look at the date on pages of policy manuals you see dates like 1998, 1999, etc. on the bottom-- they have stolen pages from various other company's policy manuals and stuck them in their policy manual, not even cleaning up the pages enough to make them not show those old dates, or fix them to be reflective of what they needed to be saying for the situation they supposedly covered. LAZY TO THE MAX and SLOPPY, like the way they have done all their software programs and paperwork.
But then I'm not telling you anything you haven't gotten from them too.

I think the above poster meant that it was a private contract from a hospital or facility. [2006-06-15]
I also don't know of anyone paying that high, but I get $2.00, and links. If it is a CT of the abdomen and pelvis for example, I get $4.00.
Does'nt MQ have to pay penalties to the client [2006-06-07]
when they are out of TAT? My old boss (before the offices closed) told us once just how much in penalties MQ had to pay to the client being out of TAT.
That said, with weekend work being out, even clearing it up on Monday mornings will not resolve the main issue, TAT and contracts to keep within?

Varies [2008-09-22]
Yep, it varies from account to account, and from there, report type to report type. Some reports are 2 hours from the time of dictation--not to mention, if things aren't kept up on, it can be a runaway train.
I heard that MQ gets fined in a big way when things are out of contract.
A lot of it makes no sense to me. [2008-09-21]
1) If there are truly very backed up accounts, these should be the jobs coming up.
2) Since I have worked for MQ, I have noticed these bonus periods have come at the same time, they are always on the weekend. I suspect another one will come near Christmas.
3) I wonder if these bonus periods are near a lot of contract renewal dates.
4) For me, working for the extra bonus has not been worth it because my hands pay for it.
Sphereis must have a exclusivity clause in [2008-09-18]
their contract. If they don't, they can't control you.
When I interviewed with Spheris, they sure seemed to demand and paid a lot less. As I recall, they wanted me to use their computer and pay for the equipment with reimbursement if I stuck with them for a certain period of time. Needless to say, I chose MQ over them, and I am not sorry about that choice.

I agree about the AAMT....sm [2008-09-09]
This IS what they've done for us. They could not just leave something as simple as following the basic rules of English style and grammar we all learned in grade school and middle school alone and had to start making minor changes to when and where commas, apostrophes, etc., could be used that we all now question EVERYTHING, even the things that haven't changed one iota over the years. Some of it is preference and doesn't matter, but what does matter is that in some companies, these changes, based on QA's interpretation or the audit team's interpretation, can cost an MT a raise or, in some companies, even cost her penalties and loss in wages, not to mention the time spent verifying what method is preferred or fighting a QA feedback to avoid going below 98% accuracy.
The other problem has been putting people in QA who have no clue about grammar or punctuation... and I personally believe that has been the biggest problem as they are basically giving feedback to new MTs who believe what they say to be the gospel truth! The blind leading the blind.
I have had QA tell me nauseous is not a word and should be replaced with nauseated.... tell that to Mr. Webster. Another QA changed illicit to elicit and when I challenged it, I was told to chill out, that actually, ''they meant the same thing and were interchangable.'' HOLD ON! I went straight to the owner of the company at that point and told her that she needed to QA that QA person and sure enough, that QA was canned pronto. Both the owner and I wondered how many MTs had she given incorrect information to over the years she worked there, but they believed her and never questioned her because, after all, she was QA and was supposedly qualified and supposedly knew the correct way to do things... scary thought!
BTW, this was not an MQ QA person. This was with the company I was with before MQ bought us and she was gone before MQ bought us, so it's no slam to any of you current QA gals/guys.
In any case, yes, I do blame the AAMT for making minor changes over the years in whether or not to use commas, apostrophes, etc. I don't think they've ever changed any hyphen rules (for the sake of this thread), but regardless of that, the things they have changed over the years have raised huge questions for those of us old school transcriptionsts who have transcribed per basic English grammar and punctuation skills... and now everyone questions everything, even if it wasn't something that was changed in the first place.
Shame on you AAMT or whatever your name is now. Like someone said earlier.... it wasn't broke, you didn't need to fix it.
JMHO
You are one of the lucky ones....sm [2008-09-03]
I am happy for you, really I am, so please don't be upset with me when I say that I can't understand how you can't understand the negative posts.
You make a great line rate here with 10 cents, but as you can see from some of these other posters, many MTs are making 7 cents for doing tier 3 work. You may also have some of the good ASR accounts where your production is increased enough to make as much as, or more, with ASR than with straight transcription. But please understand that your situation with MQ is not the norm, but rather the exception. You are also very lucky to have a flexible schedule that you chose... I don't know how you managed to get that luxury as most of us had to set a schedule and stick to it no matter what, but I'm happy for you that you can have the flexiblity.
I would probably stand right beside you in not understanding the negative posts if those who were posting them were making 10 cpl and had great ASR dictators and were still complaining that they wanted more, more, more or weren't getting all they wanted, then I wouldn't understand their negative posts and would wonder what they had to complain about.
But if some day your 10 cpl is dropped down to 8.5 because that is now the highest MQ will pay, your primary account doesn't renew its contract, and you are thrown into the worst of the worst dictators that you've ever heard in the cesspool, so now you can't make decent line counts which diminishes your bi-monthly paycheck and virtually destroys your chance of getting enough extra lines to earn a bonus -- if and when that day comes, I'm sure you'll then understand what the negative posts are all about.
Like I said, I'm not coming down on you, I'm really happy that you are doing well, just don't belittle these posters who have lost a lot over the years with MQ. It's not their imagination, it's what happened and it's real, it just hasn't happened to you yet.
How do I know? I'm one who used to do very well with MQ. I worked for over 13 years here, made just over 9 cpl, was pulling down 15,000-20,000 lines a pay period without breaking a sweat. My primary account got flooded with MTs who had lost their primary and were placed on it, and there wasn't enough work to go around, so began the spiral down with my paycheck. Sure, I was still making a good line rate, but with the cesspool, the ASR, and tons of unfamiliar work, I went from doing over 300-400 lph to barely making minimum 150 lph and possibly losing my benefits. I had to move on. It took several months, but I finally found a better job.
I totally understand their negative posts. What I don't understand is how people can't find the compassion to lend an ear or offer a kind word to those who are not as fortunate as them. JMHO.
Not true [2008-08-30]
When my old primary account did not want to go on ASRlast year and canceled MQ's contract, MQ kept the clerks who wanted to stay and put them on QA on other accounts. They were great, long-time, friendly clerks but they had never done MT ever, no training for that, and wouldn't know a medical word to save their own life. One told me that what she mainly does is check addresses and doctors names if there is a question on that, then sends any medical blanks in as blanks.
MQ does not choose the format of the [2008-08-26]
report, that is the facility's contract with MQ.
warning signs for losing primary? [2008-08-12]
I am just curious to those who have been through this situation if there were any signs looking back you wished you would have recognized?
Did the work completely stop or just trickle down to nothing?
Did super offer you a different account that really needed your help before your primary finally was gone?
Was the contract up or being negotiated and were you aware of that fact?
Was the account on full QA or some such other quality control issues with a window of opportunity to shape up?
Finally, if and when your primary (or primaries) faded were you given other accounts in the BOB or were you thrown to the wolves in the national workpool?
Call it what you will, but my gut is telling me my primary is on the way out no matter what the PS says- just looking for a little insight. Thanks!
Loss of primary [2008-08-12]
When it happened to me the contract was about to expire and they didn't renew. My PS put me with another PS but in the same BOB. I might say, however, that I am just as happy if not more with this new one than I had been,
it's been a while but-- [2008-08-12]
I've actually lost 2 primaries over the years. The first one was about 5 years ago. I noticed an immediate onslaught of work. At the time, I thought they were getting ready for an audit or something. Turns out, they trying to get everything done so they would start with a clean slate with the new company. The second primary I lost was about 3 years ago. The work was there 1 day and the next day it wasn't. Then a few days later, it was back but not as much. Then a few days later, nothing. After about 2 weeks, I emailed my PS and she said that the contract was renewed but that the clinic went to in-house staff and we would only be on standby.
Both times, 1 of my backup accounts was made my primary and nothing more became of it. I will say that this was prior to the whole cesspool thing, so who knows what they do now. Your PS does have a say in this, though. He/she can assign you a new primary, so don't be afraid to ask for one if this becomes the case. Also, if your PS is telling you the primary is still with MQ and your work is drying up, I would ask for a new primary with the old account as a backup. They can also do this.
My PS (back then) called us and let [2008-08-12]
us know that our account was not renewing their contract at the end of the year, she gave us aboutt a 2-month notice, then I got switched to new SA with horrible accounts.
Eight 1/2 years ago my account just stopped sm [2008-08-12]
No warning or anything. I should have remembered that the contract was around the time it left. The thing is I had just moved into a new house with a house payment almost triple to what I was paying. No jobj, nothing!. No back up.
Then a few years ago I lost my primary again, doing 300 lines an hour, no warning. Then I got a call that they would give me extra pay for a month but I wsa doing 7 hospitals!. That ws a mess and all this happened. They won't tll us because we will all jump ship and they don't want that to happen. Why I stay with them is unexplainable to me!
Is your primary okay with offshoring? [2008-08-08]
Has anyone found this out and, if so, how did you find out? Is it a good idea to ask the PS what is in our primary's contract, will they allow for offshoring or not? I guess when I find out this answer, that will make my decision whether to stay or leave. Although I'm not happy with the buyout, I love my primary and have been on it for 7 years, and it is a hometown account for me. I would hate to leave it behind.
It does not matter what they want. The contracts do not sm [2008-08-08]
say that MQ cannot send work offshore. The account has to put up with it until the contract expires. If they even know about it, that is!
right you are! [2008-08-08]
Certain clients specify in their contract no offshoring and that request has to be met or the client is able to break that contract with MQ. Some doctors also have in their contract with a facility they do not want their dictation done offshore or they will work for a different facility. The doctor does not make that decision for a whole facility, a specified board of physicians do, but they have to take in consideration they may lose some physicians in making such a decision, but maybe some facility do not inform their dictators when work is sending offshore either??
Honesly, you should feel lucky if you're not legally [2008-08-06]
deal and an issue that has been dealt with time and time and time again on mass emails, Qnet, the ethics gargage and code of conduct, etc. Its a huge deal, time card fraud, and it does not matter that you are paid on production. You know better. MQ, while I loathe them personally, has had to pay millions and millions of dollars in lawsuits and fines and penalties for time card issues after being sued by MTs and caught by Dept of Labor. Everything you make is based on your time card issues, so you have no excuse. It is also crazy to be complaining about it on the internet, and giving way too much detail to identify you. And filing WC to boot. As someone else said, hopefully lesson learned for you, but you broke the law, federal law.
Your worries are valid and spot on. [2008-08-04]
If you have read all the links regarding news stories and interviews with CBay, you will see that they have indeed wanted certain accounts and have gone after the services who have those accounts, and, of course, with the contract prices already in place with the previous company and then shipping off the work to their workers in India, there is a pretty penny to be made.
The small company I worked for closed down because our accounts were poached and the work sent off to India. Plain and simple, the hospitals went for cheaper. Hard to compete with 6 cents a line, something I have seen advertised on the internet by an off shore.
As far as our wages, that ship has sailed a long time ago. Over the last 10 years or so, since the competition of off-shore companies, pay had gone down by several cents a line over the years.
As far as something being done about the situation of pay and off shore work, well AAMT (or what ever they call themselves now) did not address this problem and has spent their time working on elevating the stature of this occupation. That is why I have not been a member in a long time. I was sickened by their lack of response to this concern of their members.
And then there are our elected officials who have done little to nothing on our behalf.
I have been wondering at what point does CBay become a monopoly - or have they already?.... With the take over of us, they are the largest MT company in the world.
Well, prior to Costa Brava, our hedge fund, [2008-08-01]
buying into the company only recently, MQ was able to get away with anything it wanted to, every time. Not one person ever stood up to them. So, MQ board had mostly Philips employees on it, board of directors who make the decisions, and the ones who represented MQ, well, first they were outnumbered, and second, as has been charged in the second newer lawsuite, the MQ board were really in the pockets of Philips, too. So, its Philips who wants to dump us. Its Philips who always was in control. Philips was the one who wanted to the ASR. When they bought the majority stake of MQ years back, it was written in the contract that each year more and more of the work had to be converted to ASR, with a final goal of 100%. Philips never ever got stopped until Costa Brava. They bought into the company, own a large enough share, and have been suing MQ mgmt and Philips ever since. They are our heroes, essentially, though again their motives are obviously for their financial protection. However, right now their interest is our interest as well. So, Costa Brava had their eye on MQ for a while, and bought into the company, believing it to be a cash cow with potential for huge income, but believing that is has been sorely mismanaged. So, they invested and came out swinging to straighten things out. Now, their latest suit is to stop this sale to Cbay, as not all parties involved were consulted or even agree to the sale. They believe, and I believe them, that the sale of MQ to Cbay is NOT in MQ's best interests, only to Philips, so, in other words, its danger to MQ. They are trying to fight it and gain fair control of the board and thus management decisions. Again, their motives are financial, but I truly believe they are protecting their investment and fighting to help the company be the company it can be, and should have been, had it not been run off the track. Right now they are the closest thing to heroes that we have, and I'm rooting for them! Very long explanation, but its just a brief one, trying to explain as best I can as quickly as I can.
both points are NO [2008-07-31]
nope - 1) already have equipment supplied and 2) contract arrangement for company clearly states no off-shoring....outsourcing perhaps.....not but off shore....it's not the outsourcing that gets me.....it's the off-shoring that does. Case closed. I'm done on this board and with MQ.
One little flaw in your US-MT-only clients...sm [2008-07-31]
A company can still have a ''store front'' here in the US and have the work done overseas.
You said you know for a fact that not all clients want their work sent offshore, but I can tell you that I know for a fact that it is still done and done without the client's knowledge. I can't say anything regarding MQ doing this because I don't know that they do, and would guess right now that they don't, they have no reason to as they still have a lot of US MTs to do those clients.
But I have a very close MT friend who has worked at a company (two actually) in management and in QA, where the contracts state no reports sent offshore. It's amazing the wording that can be used in a contract to leave loopholes.
In one instance... and the reason why she quit that company... all of their work was done overseas by MTs, QA'd here in the US and sent it to the client. She wasn't even aware for a while that she was QAing offshore work because it was all coming in with American-sounding names... Sally Jones, Kathy Anderson, etc... all made-up names. She started suspecting something when she started seeing some celebrity names coming through for the names of the MTs transcribing them (how dumb do they think we are?) and confronted her MTSO about it. That's when she found out that all of the work was done by overseas MTs and edited by US MTs.... since they logged into the system in the United States via the internet, technically it never left US soil.
Where there's a will there's a way and with a shrewd business man such as Kumar, I have no doubt they will be able to find a way to convince their clients that work never left the US.
I know that...sm [2008-07-31]
and that's what I said... I don't know about MQ, but doubted that they did at this time... with all their legal problems the past few years, I can't imagine they would even try to do anything that wasn't on the up and up right now since they are being so closely watched by the SEC and other regulatory agencies.
What I'm saying is... if the company who is taking controling interest in MQ, namely CBay and new CEO Kumar, wants to do this, and there's reason to believe they do as they've stated their intentions, there are plenty of ways to do it without the client knowing about it.
Or they could simply drop those clients who refuse to offshore their work... there are plenty who don't care as long as the work is done correctly, and the bottom line is money, so if CBay/Kumar have to pay more to keep those clients, they may not think they're worth it.
So even though your primary account at MQ is a US-only account, it doesn't mean they'll still be here at the end of their contract with MQ, and it doesn't mean that they have dropped MQ, maybe MQ will have dropped them since they won't allow work done offshore... contracts can be renewed or not renewed by either party.... something to think about.
I agree with you....sm [2008-07-31]
There are clients, like your facility, who are going to be strict about this and are going to check up on and investigate and insist on proof that their work is not being sent offshore... unfortunately, clients like this are very few and far between and most don't have a clue and wouldn't even bother to ask... mabye don't even want to know. Also, unless the doctors at the facility are on the board and/or part owners of the facility, they have no say in what transcription company does their transcription... and in my area at least, where there isn't another hospital around for hundreds of miles, unless they want to uproot their family and move, they probably wouldn't quit over such a small thing as who does their transcription... they just want it done quickly and correctly.
I'm happy for you that your account is one of those clients who cares and checks up on MQ and I sincerely hope that they continue to stay with MQ for your sake. But I really do think that the majority of the clients MQ has right now don't have a contract that states work can't be sent offshore, and many of those that do, won't be as diligent as your account to double check and make sure and will just take MQ's word for it that work is done on US soil by US MTs... as long as it's done correctly and with a quick TAT, they probably won't care.
I would also venture a guess that in the future, many clients who demand no offshoring of their records will have to change their stance because they too have to watch their bottom line and will be forced to find cheaper transcription services and the only ones cheap enough will be those who offshore.
It's not just MQ that is changing, it is the whole MT industry and we have a lot of history to refer to when you look at other industries that have gone the way of moving their plants/work outside of the United States....they are not coming back any time soon.
I hope I'm wrong, but I don't think the MTs or the clients are going to have a choice before long. The good MTSOs that hold their ground and stay in the US and charge a rate to the client that allows them to pay their MTs well are going to be few and far between too, but they are being pushed out of business quickly too because the clients have to cut their costs and choose cheaper services... it's happening all around us and in every industry in the US.
And like I said before...the new CEO and management of MQ can also choose not renew a contract with a client if they can't come to an agreement, so if it's going to cost them more to keep a client than it's worth to them, they can drop the client. So just because an account is US only now doesn't mean there's no guarantee it's going to be with MQ in the future when its contract renews. Hopefully for you, you will be able to follow your account to it's new MTSO if that happens, like you did when it came to MQ. I really do hope that for you.
They want everyone to stick around [2008-07-30]
until the bitter end so they are not out of contract when the sale occurs. They will not tell anyone what is happening; they will just hit the on/off switch.
