Legal question...sm [2007-06-01]
A friend of mine had a DC after suffering a miscarriage because she had an incomplete miscarriage at 10 weeks. After she did not get her period back with a couple of months she underwent testing by another doctorand ended up finding out that part of her uterus was removed. She talked to a couple of attorneys who only seem to want to try to get a high amount of money out of the doctor and hospital but my friend isn She and her husband are also upset that they were not told at the time of surgery or afterwards that there was a problem encountered.
Do you know of a resource to find out what a fair compensation would be for this mistake and the fact that the surgeon and hospital didn I have no idea where to point her to go. Thank you.
Legal Transcription Training [2007-05-18]
Can anyone recommend a reputable school for legal transcription training. I already have an assoc. degree in paralegal studies but haven Thanks.
legal transcription [2007-05-04]
http://www.speak-write.com/ is a company that utilizes general and legal typists. I worked for them at one point. It was nice because you could schedule yourself by the hour from week to week so if you wanted to work an hour in the morning and five in the evening you could do that. They were really flexible.
legal transcription [2007-05-01]
Does anybody know where I can begin to search for legal transcription jobs? TIA
Legal Transcription [2007-04-19]
I have done legal transcription for five years in the past. It is much easier to me than medical transcription. Once you learn the legal terminology thaton the job. There are paralegal courses.
Legal transciption [2007-04-18]
Yeah, I've been wondering as well. How far apart are medical and legal transcription and court reporting/transcription? If you can do one, do the rest fall in place with a little training?
Legal Transcription [2007-01-19]
Yeah, that would be great. But I think it's pretty difficult to find legal work from home unless it's contract work only. If you don't need benefits and can exist on contract work only legal is great to do from home. If you don't need to work from home you can make great money working as a law office word processing operator. I'm training for MT just because I want to work from home and have some benefits.
Good question [2007-01-17]
I'm a retired police officer think maybe I would prefer legal transcription over medical
Legal transcription [2006-12-24]
I am a medical Transcriptionist and have done legal work. I am transcribing something now that will be admitted to court. I sure hope Ialter my transcription.
Happy holidays and thanks for your input. A little nervous about this one as I'm doing it on a trust basis.
transcribing ver batim "F" word sm [2006-12-16]
Transcribing a legal document from dictated material. The dictator is using the F word bomb, not that often, but it is a part of his complaint about language used on him. Iexpletive used. If it's verbatim, I think I owe it to the client to get his word across. What do you think? I am going to ask the same question on the other board, although it will apply to general medical transcription. I have been told in this case I may use quotation marks. Anyone else been in this dilemma?
Legal recording help sm [2006-12-12]
I posted on main board and thought you may help as well. Client needs to rerecord some micro tapes for a court case. I don't know where to look as everything today is digital. Anything you legal people can help us with. Important - nice client - would love to help him. E-mail or post. Thanks!!!

I obtained my AAS in Legal Transcription, but [2006-09-07]
As I only found jobs that were offering little pay and no benefits, so I never worked in this field. I ended up going back for medical transcription and have been doing that for the past 9 years. I am now going back for my RN degree. Anyways, I went to my local community college for two years if you are looking for a place to find education in this field. Good luck to you.

Legal question - privacy violation at work [2006-08-23]
I know there are HIPAA laws to protect patients, but what about employee privacy laws? If a manager discusses private issues about other employees while he/she knows another employee is working in the same room and can overhear, is there a law addressing that? Or an agency to report it to?
Legal/Psych/Medical [2006-07-18]
I have 25 yrs of legal exper., 3 yrs of medical with emphasis on psych. Any ideas what national companies I might be able to apply to? Thanks.
How does one break into legal transcripition? sm [2006-07-17]
I'd like the names of a few decent schools to take courses. Is it hard to work at home like I do in MT? Are their nationals like MT? TIA!
Legal transcriptionist, too [2006-07-16]
I, too, am a legal Transcriptionist and started out in a very similar way. Worked for a law firm for a while and transcribed briefs and correspondence for the attorneys. Once my daughter was born I wanted to find something that I could do at home and started my transcription business. And I agree, it has been a long journey and I'm still trying to build up my client base 10 years later in order to make enough so that our family is not so dependant on my husband's income. My clients are varied and include insurance companies, state agencies, translators, authors, court reporters, attorneys, etc. The problem is that the work is not consistent so I must always be on the lookout for new opportunities. Anyone with any marketing ideas I would love to hear what is working for you.
I have long yearned for a legal transcription message board and even toyed with the idea of creating one myself if I had enough techno savvy because the medical field is flooded with message boards but the legal field really has nowhere to go to discuss issues that are unique to our chosen field of work. So THANK YOU for including this board on your website for us!
help.....worked for hospital as IC and [2008-11-09]
contract was with hospital. Company who owned hospital (not the same as hospital) filed BK, and did not pay last two paychecks. I was just told new owner of hospital will not pay any vendor prior to purchase of hospital. First check bounced, and told next check not even going to be cut.
my question is: since I am contracted with the hospital and not the old owner directly, doesn If the old company filed BK, i was not listed as a creditor or served with BK papers.

liability [2008-10-24]
Hi,
I have no idea what the legal requirements are for this, but I would certainly think that if we needed it, we would have it taken from our checks, or be required to buy it up front at every company. The very first company I worked for 13 years ago said one of the requirements wasproof of$500,000 liability insurance to work for them. I never heard another word about it after I was hired on, and I I doubt it Sure hope not, as who could afford yet another deduction/expense?
IC in Maine [2008-10-14]
They are recognized in Maine. I was an IC in Millinocket for years. The state of Maine does recognize it, as they were clients of mine on more than one occasion. :)
no pay [2008-09-30]
Depending on the state you live in, small claims would be a good option and affordable. If you win the court case, there are steps you can take to get paid. Plus, you would be able to recover your costs for taking them to court. Also, try looking them up with the BBB and state authorities to file complaints.
Look in the archives [2008-09-29]
I have not personally had this problem, but many others have, and there is information about how to go about contacting someone to get some help. There is also small claims court, which here in NC is only $35.00 to process. Please look in the archives and best of luck to you. I'm so sorry you've been taken like this.
no pay [2008-09-28]
I was wondering if there is any recourse that an IC can take against a company/person who has not paid them for transcription work done for that company. This company has disconnected all of their phone lines and email addresses and has not paid what is owed to me (and others) for work done. I am owed about $1400. Thanks for any help. SC
The MTs initials . . . [2008-09-01]
You're ok. The MT's initials don't have to be there.
The MT is not legally responsible for the content of the document-the physician is. Once he signs it, he's responsible.
Mind you, I'm not a lawyer, but you can see from the BOS that the initials aren't required. If there was a legal requirement, you would have heard lots about it before now. There would be a whole chunk of the law section of HIM texts devoted to it--and there isn't. If you WERE responsible, you would have to sign the report in ink (or electronically), and you don't see MTs doing that.
Your initials can be removed. If you provide the electronic file for him to print, he can change anything he wants. You can't be held responsible for what ends up in the record if what ends up there can be changed.
I wonder if he thinks that he'll save money by not having to pay for the extra characters?
Another possibility is that he doesn't want anyone to know you did his transcription. He might feel he needs to keep his options open in terms of fiddling with reports later, perhaps when he's trying to bill a higher level of service, get a denied claim paid, or if he needs to cover up a bad outcome. If your initials are all over his records, an investigator might know right where to go for copies of originals and testimony as to what you transcribed. :)
Doctor wants my initials off document [2008-08-26]
I am not sure of the Legal ramifications if any to taking my initials off documents as requested by a physician. He is a relatively new account to me, and he is now requesting that I remove my initials. Before I answer him yes or no, I want to know if this is advisible to do. Please help!! Thank you very much!
I'm no expert, but the BOS [2008-08-26]
In the format section, under initials, It is common practice to include originator and Transcriptionist initials at the end of the report. When used, enter the initials.....
It appears to me because it says when used they don Again, I am no legal expert. As an MT, I'd rather have my initials on my work.

Scarry!!! Docs and nurses entering drugs and dosages into online charts. (sm) [2008-05-08]
Most of my docs cannot spell medical terms. They can The nurses are for the most part useless - no ARNP I ever asked could help me with a medical term.
I just spoke to my HMO. They are now offering personalOnline-charts showing
visits, tests, immunizations, etc. of what you personally had done.
I asked EXACTLY HOW DOES THIS INFO GET INTO THE SYSTEM, at what point?
The woman said: It is input by the doc and the nurses.
I shuttered!
There goes the end of quality health care as we used to know it!

other probs [2008-02-25]
Other problems with using a cell phone include who is around you. I'm sure we've all heard the story of the divorce attorney who was discussing the case in a bathroom stall and the opposing attorney was sitting in the next stall. Cell phones are bad if people are around. Also in states where cell phone use is prohibited in moving vehicles, doctors can break the law by doing so. I had one in California where the law is hands-free only I believe. Genius had Tom-Tom giving directions in the background while dictating!
Twas the night before Christmas - legally speaking [2007-12-12]
This was given to me by one of my law professors. Thought it was cute -
Twas The Night Before Christmas, Legally Speaking Whereas, on or about the period between sunset and sunrise, especially the hours of darkness, prior to Christmas, there did occur at a certain improved piece of real property (hereinafter referred to as the House) a general lack of stirring by all creatures therein, including but not limited to, a small rodent of the family Mus musculus, characteristically having a pointed snout, small rounded ears, and a long naked or almost hairless tail. A variety of foot apparel, e.g., stocking, socks, etc., had been affixed by and around the chimney in said House in the hope and/or belief that St. Nick a/k/a/ St. Nicholas a/k/a/ Santa Claus (hereinafter referred to as Claus) would arrive at an unknown time thereafter. The minor residents, i.e., the children, of the aforementioned House were located in their individual and respective flat, rectangular frames containing a mattress resting on springs therein, and were engaged in nocturnal hallucinations, i.e., dreams, wherein vision of confectionery treats, including but not limited to, candies, nuts and/or sugar plums, did dance, cavort, and otherwise appear in said dreams. Whereupon the Party of the first Part (sometimes hereinafter referred to as I), being the joint-owner in fee simple of the House with the Party of the second Part (hereinafter referred to as Mamma), and said Mamma had retired for a sustained period of sleep. (At such time, the parties were clad in various forms of headgear appropriate for the nocturnal condition, e.g., kerchief and cap.) Suddenly, and without prior notice or warning, there did occur upon the unimproved real property adjacent and appurtenant to said House, i.e., the lawn, a certain disruption of unknown nature, cause, and/or circumstance. The Party of the first Part did immediately rush to a window in the House to investigate the cause of said disturbance. At that time, the Party of the first Part did observe, with some degree of wonder, amazement, and/or disbelief, a miniature sleigh (hereinafter referred to as the Vehicle) being pulled and/or drawn very rapidly through the air by approximately eight (8) hoofed ruminant mammals of the family Cervidae, characteristically having deciduous antlers (hereinafter referred to as reindeer). The driver of the Vehicle appeared to be and in fact was, the previously referenced Claus. Said Claus was providing specific direction, instruction, and guidance to the approximately eight (8) aforementioned reindeer and specifically identified the animal co-conspirators by name: Dasher, Dancer, Prancer, Vixen, Comet, Cupid, Donner, and Blitzen (hereinafter the Deer). (Upon information and belief, it is further asserted that an additional co-conspirator named Rudolph may have been involved.) The Party of the first Part witnessed aforementioned Claus, the Vehicle, and the Deer intentionally and willfully trespass upon the roofs of several residences located adjacent to, and in the vicinity of, the House, and noted that the Vehicle was heavily laden with packages, toys, and other items of unknown origin or nature. Suddenly, without prior invitation or permission, either express or implied, the aforementioned Vehicle arrived at the House, and said Claus entered said House by way of the chimney. Said Claus was clad in a red fur suit, which was partially covered with residue from the chimney, and he carried a large sack containing a portion of the aforementioned packages, toys, and other unknown items. He was smoking what appeared to be dried leaves from the plant of the genus Nicotiana a/k/a tobacco in a small pipe in blatant violation of local ordinances and health regulations. Claus did not speak, but immediately began to fill the stocking of the minor children, which hung adjacent to the chimney, with toys and other small gifts. (Said items did not, however, constitute gifts to said minor pursuant to the applicable provisions of the United States Tax Code.) Upon completion of such task, said Claus touched the side of his nose and flew, rose, and/or ascended up the chimney of the House to the roof where the aforementioned Vehicle and Deer waited and/or served as lookouts. Claus immediately departed for an unknown destination. However, prior to the departure of said Vehicle, Deer, and Claus from said House, the Party of the first Part did hear Claus state and/or exclaim: Merry Christmas to all and to all a good night! Or words to that effect. --Anonymous

Fair compensation [2007-07-06]
Any good personal injury lawyer knows better than anyone what fair compensation for you loss would be. The figure will be based on the awards granted in similar malpractice cases in your area. It varies from state to state, sometimes even county to county. Do not second-guess your attorney. Let him or her decide what the case is worth.

MT & court reporting are WORLDS apart [2007-05-23]
Having studied both court reporting and medical transcription, I can tell you that they are worlds apart. Court reporters learn 'machine shorthand' and by using this and their steno machine, they can 'type' 200+ wpm. They type in syllables and entire phrases or sentences, not by single characters as we do in MT.
Actually, people who edit for MT and court reporting actually have more closely related jobs. Check out www.scopists.com Some court reporters type in Real-Time, and the people who scope for them just basically clean up their work, fix missed strokes, etc. There are also people who 'translate'/type the machine shorthand, which is much more detailed and takes a lot more studying/schooling. Another site to check out is StenEd for resources and reference materials.
You could, of course, always apply to be a legal secretary and type in a law office. :D
