Legal question...sm [2007-06-01]
A friend of mine had a DC after suffering a miscarriage because she had an incomplete miscarriage at 10 weeks. After she did not get her period back with a couple of months she underwent testing by another doctorand ended up finding out that part of her uterus was removed. She talked to a couple of attorneys who only seem to want to try to get a high amount of money out of the doctor and hospital but my friend isn She and her husband are also upset that they were not told at the time of surgery or afterwards that there was a problem encountered.
Do you know of a resource to find out what a fair compensation would be for this mistake and the fact that the surgeon and hospital didn I have no idea where to point her to go. Thank you.

Legal question - privacy violation at work [2006-08-23]
I know there are HIPAA laws to protect patients, but what about employee privacy laws? If a manager discusses private issues about other employees while he/she knows another employee is working in the same room and can overhear, is there a law addressing that? Or an agency to report it to?

help.....worked for hospital as IC and [2008-11-09]
contract was with hospital. Company who owned hospital (not the same as hospital) filed BK, and did not pay last two paychecks. I was just told new owner of hospital will not pay any vendor prior to purchase of hospital. First check bounced, and told next check not even going to be cut.
my question is: since I am contracted with the hospital and not the old owner directly, doesn If the old company filed BK, i was not listed as a creditor or served with BK papers.

Depending on the state you live in, small claims would be a good option and affordable. If you win the court case, there are steps you can take to get paid. Plus, you would be able to recover your costs for taking them to court. Also, try looking them up with the BBB and state authorities to file complaints.
Twas the night before Christmas - legally speaking [2007-12-12]
This was given to me by one of my law professors. Thought it was cute -
Twas The Night Before Christmas, Legally Speaking Whereas, on or about the period between sunset and sunrise, especially the hours of darkness, prior to Christmas, there did occur at a certain improved piece of real property (hereinafter referred to as the House) a general lack of stirring by all creatures therein, including but not limited to, a small rodent of the family Mus musculus, characteristically having a pointed snout, small rounded ears, and a long naked or almost hairless tail. A variety of foot apparel, e.g., stocking, socks, etc., had been affixed by and around the chimney in said House in the hope and/or belief that St. Nick a/k/a/ St. Nicholas a/k/a/ Santa Claus (hereinafter referred to as Claus) would arrive at an unknown time thereafter. The minor residents, i.e., the children, of the aforementioned House were located in their individual and respective flat, rectangular frames containing a mattress resting on springs therein, and were engaged in nocturnal hallucinations, i.e., dreams, wherein vision of confectionery treats, including but not limited to, candies, nuts and/or sugar plums, did dance, cavort, and otherwise appear in said dreams. Whereupon the Party of the first Part (sometimes hereinafter referred to as I), being the joint-owner in fee simple of the House with the Party of the second Part (hereinafter referred to as Mamma), and said Mamma had retired for a sustained period of sleep. (At such time, the parties were clad in various forms of headgear appropriate for the nocturnal condition, e.g., kerchief and cap.) Suddenly, and without prior notice or warning, there did occur upon the unimproved real property adjacent and appurtenant to said House, i.e., the lawn, a certain disruption of unknown nature, cause, and/or circumstance. The Party of the first Part did immediately rush to a window in the House to investigate the cause of said disturbance. At that time, the Party of the first Part did observe, with some degree of wonder, amazement, and/or disbelief, a miniature sleigh (hereinafter referred to as the Vehicle) being pulled and/or drawn very rapidly through the air by approximately eight (8) hoofed ruminant mammals of the family Cervidae, characteristically having deciduous antlers (hereinafter referred to as reindeer). The driver of the Vehicle appeared to be and in fact was, the previously referenced Claus. Said Claus was providing specific direction, instruction, and guidance to the approximately eight (8) aforementioned reindeer and specifically identified the animal co-conspirators by name: Dasher, Dancer, Prancer, Vixen, Comet, Cupid, Donner, and Blitzen (hereinafter the Deer). (Upon information and belief, it is further asserted that an additional co-conspirator named Rudolph may have been involved.) The Party of the first Part witnessed aforementioned Claus, the Vehicle, and the Deer intentionally and willfully trespass upon the roofs of several residences located adjacent to, and in the vicinity of, the House, and noted that the Vehicle was heavily laden with packages, toys, and other items of unknown origin or nature. Suddenly, without prior invitation or permission, either express or implied, the aforementioned Vehicle arrived at the House, and said Claus entered said House by way of the chimney. Said Claus was clad in a red fur suit, which was partially covered with residue from the chimney, and he carried a large sack containing a portion of the aforementioned packages, toys, and other unknown items. He was smoking what appeared to be dried leaves from the plant of the genus Nicotiana a/k/a tobacco in a small pipe in blatant violation of local ordinances and health regulations. Claus did not speak, but immediately began to fill the stocking of the minor children, which hung adjacent to the chimney, with toys and other small gifts. (Said items did not, however, constitute gifts to said minor pursuant to the applicable provisions of the United States Tax Code.) Upon completion of such task, said Claus touched the side of his nose and flew, rose, and/or ascended up the chimney of the House to the roof where the aforementioned Vehicle and Deer waited and/or served as lookouts. Claus immediately departed for an unknown destination. However, prior to the departure of said Vehicle, Deer, and Claus from said House, the Party of the first Part did hear Claus state and/or exclaim: Merry Christmas to all and to all a good night! Any good personal injury lawyer knows better than anyone what fair compensation for you loss would be. The figure will be based on the awards granted in similar malpractice cases in your area. It varies from state to state, sometimes even county to county. Do not second-guess your attorney. Let him or her decide what the case is worth.
This might sound like an odd [2007-06-01]
question, but are you certain that your friend understands her diagnosis completely?I have a friend who told me that the doctor gave her 2 years to live because of some problem with her liver. It turns out that she was just in a bad emotional state when she went to her doctor and did not really comprehend what she was being told. She assumed the worst. She has no medical background at all so she was easily confused.
I would wonder if your friend is mistaken. I hope, for her sake, that she is. I would suggest she get another opinion.
transcribing ver batim "F" word sm [2006-12-16]
Transcribing a legal document from dictated material. The dictator is using the F word bomb, not that often, but it is a part of his complaint about language used on him. Iexpletive used. If it's verbatim, I think I owe it to the client to get his word across. What do you think? I am going to ask the same question on the other board, although it will apply to general medical transcription. I have been told in this case I may use quotation marks. Anyone else been in this dilemma?

I couldn't respect that manager enough to work there anymore. It's a shame, because the rest of the job was a great fit for me, I liked the other people, and the doctors were very appreciative of my work. Even the good hourly pay and benefits didn't make up for her deficits. Their loss.
I obtained my AAS in Legal Transcription, but [2006-09-07]
As I only found jobs that were offering little pay and no benefits, so I never worked in this field. I ended up going back for medical transcription and have been doing that for the past 9 years. I am now going back for my RN degree. Anyways, I went to my local community college for two years if you are looking for a place to find education in this field. Good luck to you.

certification for typing [2006-07-10]
have any of you ever heard of becoming certified on Brainbench.com's website? They are an ISO certifier and you can take the typing test for free. If you attain a certain score you are designated certified and can use that in your applications, resume, etc. A lot of employers pay attention to that so I hear. Anyway, just thought I'd pass that along. I was certified today as a master typist....sounds kind of pretentious, but maybe it will do some good for future work. Who knows?
