A friend of mine had a DC after suffering a miscarriage because she had an incomplete miscarriage at 10 weeks. After she did not get her period back with a couple of months she underwent testing by another doctorand ended up finding out that part of her uterus was removed. She talked to a couple of attorneys who only seem to want to try to get a high amount of money out of the doctor and hospital but my friend isn She and her husband are also upset that they were not told at the time of surgery or afterwards that there was a problem encountered. Do you know of a resource to find out what a fair compensation would be for this mistake and the fact that the surgeon and hospital didn I have no idea where to point her to go. Thank you.

It was nice because you could schedule yourself by the hour from week to week so if you wanted to work an hour in the morning and five in the evening you could do that. They were really flexible.

Yeah, that would be great. But I think it's pretty difficult to find legal work from home unless it's contract work only. If you don't need benefits and can exist on contract work only legal is great to do from home. If you don't need to work from home you can make great money working as a law office word processing operator. I'm training for MT just because I want to work from home and have some benefits.

There was one in the office I left at the hospital. She made speculations about everyone. The worst was probably saying the MT lead was having memory problems and felt she had Alzheimer's. That in itself would be enough for me to bring legal action against someone. But, she only said it like, I am so worried that Sandy has Alzheimer's. She forgets everything. Needless to say, this particular woman wanted very much to be the lead as she needed an increase in pay badly. I have personally listened to her and knew she was doing the same thing to me with the others. The real hypocrisy of it all was she was a devote Christian with pictures of Jesus all around her cubicle. I never met such an evil woman.

As I only found jobs that were offering little pay and no benefits, so I never worked in this field. I ended up going back for medical transcription and have been doing that for the past 9 years. a couple of years ago and there were a couple of instances of employees discussing private issues of other employees. Those employees were reported to HR by another employee who overhead the conversations,investigated and terminated. You may want to read your employee manual. It might state in there what to do. Manager or not, privacy is still privacy.

I know there are HIPAA laws to protect patients, but what about employee privacy laws? If a manager discusses private issues about other employees while he/she knows another employee is working in the same room and can overhear, is there a law addressing that? Or an agency to report it to?

contract was with hospital. Company who owned hospital (not the same as hospital) filed BK, and did not pay last two paychecks. I was just told new owner of hospital will not pay any vendor prior to purchase of hospital. First check bounced, and told next check not even going to be cut. my question is: since I am contracted with the hospital and not the old owner directly, doesn If the old company filed BK, i was not listed as a creditor or served with BK papers.

Hi, I have no idea what the legal requirements are for this, but I would certainly think that if we needed it, we would have it taken from our checks, or be required to buy it up front at every company. The very first company I worked for 13 years ago said one of the requirements wasproof of$500,000 liability insurance to work for them. I never heard another word about it after I was hired on, and I I doubt it Sure hope not, as who could afford yet another deduction/expense?

I just received a copy of my own op report and there were no initials which really upset me because I wanted to see if any of my cohorts worked on my report. There were numbers and job numbers which I guess they could trace. I saw a couple of errors but shall shut up about it. It is interesting though, I do know of one place that would increase the document size and re-charge for it. It could be a lot of things, and hopefully it will all come out in the wash later on. I would be VERY curious but cautious, a job is a job in today's world, just smile and nod a lot but don't do anything illegal and you'll be okay. Save any documentation.

I was wondering if there is any recourse that an IC can take against a company/person who has not paid them for transcription work done for that company. This company has disconnected all of their phone lines and email addresses and has not paid what is owed to me (and others) for work done. I am owed about $1400. Thanks for any help. SC

The MTs initials . . . [2008-09-01]
You're ok. The MT's initials don't have to be there. The MT is not legally responsible for the content of the document-the physician is. Once he signs it, he's responsible. Mind you, I'm not a lawyer, but you can see from the BOS that the initials aren't required. If there was a legal requirement, you would have heard lots about it before now. There would be a whole chunk of the law section of HIM texts devoted to it--and there isn't. If you WERE responsible, you would have to sign the report in ink (or electronically), and you don't see MTs doing that. Your initials can be removed. If you provide the electronic file for him to print, he can change anything he wants. You can't be held responsible for what ends up in the record if what ends up there can be changed. I wonder if he thinks that he'll save money by not having to pay for the extra characters? Another possibility is that he doesn't want anyone to know you did his transcription. He might feel he needs to keep his options open in terms of fiddling with reports later, perhaps when he's trying to bill a higher level of service, get a denied claim paid, or if he needs to cover up a bad outcome. If your initials are all over his records, an investigator might know right where to go for copies of originals and testimony as to what you transcribed. :)

In the format section, under initials, It is common practice to include originator and Transcriptionist initials at the end of the report. When used, enter the initials..... It appears to me because it says when used they don Again, I am no legal expert. As an MT, I'd rather have my initials on my work.

Last hospital job I had, supervisor had relative also working under her. Even though my average line count was double anyone who worked there, and I worked the night shift,I was told that myself and the only other girl I worked with talked too much. Thiswas the girl who helped me train my ear on the ESLs there, became my best friend, had no problem with me talking to her, or talking to me, had an awesome line count and accuracyherself, and left shortly after I did. I left because the super and her SIL(can you saynepitism) ended up setting me up like a bowling pin.Jealousy is an ugly thing. Now I like to imaginethose typesfighting amongst themselves. I spend my days getting the job done, while they spend their days conniving how to make someone who is getting the job done look bad. What is amazing is that the most supposedly educated higher ups dondon BTW, not long after I quit, everyone involved was fired including the super, director of MR, and head of Risk Management who also managed to get involved.The only one left was the SIL, instigator, trouble maker. Looks like she wrecked havoc on everyone around her, not just me. If you have that much time to cause trouble, and complain about nothing, deflect attention from your lack, then you surely candoing your job!! This was given to me by one of my law professors. Thought it was cute - Twas The Night Before Christmas, Legally Speaking Whereas, on or about the period between sunset and sunrise, especially the hours of darkness, prior to Christmas, there did occur at a certain improved piece of real property (hereinafter referred to as the House) a general lack of stirring by all creatures therein, including but not limited to, a small rodent of the family Mus musculus, characteristically having a pointed snout, small rounded ears, and a long naked or almost hairless tail. A variety of foot apparel, e.g., stocking, socks, etc., had been affixed by and around the chimney in said House in the hope and/or belief that St. Nick a/k/a/ St. Nicholas a/k/a/ Santa Claus (hereinafter referred to as Claus) would arrive at an unknown time thereafter. The minor residents, i.e., the children, of the aforementioned House were located in their individual and respective flat, rectangular frames containing a mattress resting on springs therein, and were engaged in nocturnal hallucinations, i.e., dreams, wherein vision of confectionery treats, including but not limited to, candies, nuts and/or sugar plums, did dance, cavort, and otherwise appear in said dreams. Whereupon the Party of the first Part (sometimes hereinafter referred to as I), being the joint-owner in fee simple of the House with the Party of the second Part (hereinafter referred to as Mamma), and said Mamma had retired for a sustained period of sleep. (At such time, the parties were clad in various forms of headgear appropriate for the nocturnal condition, e.g., kerchief and cap.) Claus did not speak, but immediately began to fill the stocking of the minor children, which hung adjacent to the chimney, with toys and other small gifts. (Said items did not, however, constitute gifts to said minor pursuant to the applicable provisions of the United States Tax Code.) Upon completion of such task, said Claus touched the side of his nose and flew, rose, and/or ascended up the chimney of the House to the roof where the aforementioned Vehicle and Deer waited and/or served as lookouts. Claus immediately departed for an unknown destination. However, prior to the departure of said Vehicle, Deer, and Claus from said House, the Party of the first Part did hear Claus state and/or exclaim: Merry Christmas to all and to all a good night! question, but are you certain that your friend understands her diagnosis completely?I have a friend who told me that the doctor gave her 2 years to live because of some problem with her liver. It turns out that she was just in a bad emotional state when she went to her doctor and did not really comprehend what she was being told. She assumed the worst. She has no medical background at all so she was easily confused. I would wonder if your friend is mistaken. I hope, for her sake, that she is. I would suggest she get another opinion.

MT & court reporting are WORLDS apart [2007-05-23]
Having studied both court reporting and medical transcription, I can tell you that they are worlds apart. Court reporters learn 'machine shorthand' and by using this and their steno machine, they can 'type' 200+ wpm. They type in syllables and entire phrases or sentences, not by single characters as we do in MT. Actually, people who edit for MT and court reporting actually have more closely related jobs. Check out www.scopists.com Some court reporters type in Real-Time, and the people who scope for them just basically clean up their work, fix missed strokes, etc. There are also people who 'translate'/type the machine shorthand, which is much more detailed and takes a lot more studying/schooling. Another site to check out is StenEd for resources and reference materials. You could, of course, always apply to be a legal secretary and type in a law office. :D HTH!
