I could be wrong, but I read it to mean ANY federal money which includes Medicare/Medicaid, and there are probably not too many hospitals, clinics, or private doctor's offices that do not have at least 1 Medicare/Medicaid patient.  Seems to me they would not be too worried about all the listed countries for off-shoring if it was only VA, since there was already a big stink about off-shoring VA records.  But then, as I said, I could be reading it wrong.  I guess only time will tell.

Here's the scoop: As an IC, you are responsible for all 15.3% of your combined social security (12.4%) and medicare taxes (2.9%).

As a statutory MT or a full employee, the MTSO will pay half, or 7.65%, of your social security and medicare taxes. It is only as an IC or statutory that you are able to fully deduct your home office-related expenses on your tax return. I think an employee can only take SOME of the home-office write-offs, but I am not sure which ones.

Also of note is that only the first $92,000 of your income is subject to the SS and MC taxes (not that many of us make this much, but it's good to know!) However, you are only required to report your income if you made over $400 that year.

When you file your federal taxes at the end of the year, you will have to pay a self-employment tax which is what takes care of your SS and MC taxes.

If you expect to OWE more than $1000 in self-employment taxes at the end of the year, then you will actually need to make quarterly estimated tax payments or risk paying a penalty fee when you file annually. To compute that, I believe that you would owe more than $1000 in self-employment taxes if your taxable income is more than $6500 per year (which hopefully includes nearly all of us!).

If you can find a company who will treat you as an IC (not binding you to specific schedules, etc) yet will hire you to a statutory position, then this, in my opinion, is the way to go.

For instance, I currently work for two companies, one as an IC and one as statutory. They both pay me the same per line, but since the statutory one also pays half of my SS and MC taxes, it's like taking my line count and adding 7.65% to it!

You may ask why I don't just go full-time with the statutory--the answer is this: My IC account has a lot of standards, so I actually make about the same, if not more, even after I consider the fact that I am responsible for all of my taxes for income made with this account.

I probably should have included the hospital...
...in the addressees.  My point was that this penny-wise-pound-foolish approach to cost cutting is creating a monster, whether it's the client hospital or the MTSO making the decision to go VR.  (I've never gotten through my skull how it's more cost-effective to send work offshore, that needs to be completely reconstructed by QA here.)  I guess that once you have developed the software and installed the system VR works for free and cheaper editing labor would cost much less than having it transcribed by an MT in the first place.  But at what additional cost?  These reports end up in court as part of law suits.  You would think a hospital would prefer to get it right rather than cheap, wouldn't you?  But aren't these the same hospitals that cut nursing staff, then work the remaining nurses into the ground because overtime is cheaper than paying benefits for more employees?  Maybe we just have to face that, like the buggy whip makers a century ago, our skills are no longer required.

I have been with Fast Chart over 2 years. They DO pay for spaces and the paperwork confirms it. They also compensate for headers. The Radiology and Acute Care pays the most, 9 cents I think. Most importantly they have work.

My reasoning is that I believe part of the reason line counts are dropping is, due to automation with computers, expanders, etc., MTs are able to produce greater lines in less time than they were able to produce on typewriters. JMO (but I really don't think it's JMO, I think it's a fact).
Shorthand is included in their software, and yes you can sm

use the internet -- you have to be connected in order to do the work.

I once had a group practice client, which included ...sm
6 physicians. The most irritating one was the doc from India who had been in the U.S. for at least 15 years (I know this because I went to school with his children), and refused to even work on losing at least a small part of his accent. He was so ridiculous, and each time I typed his work, I said to myself I swear this guy purposely works at keeping his thick accent just to irritate me! Interestingly, 2 of his partners in the practice were ESL (had only been in the U.S. for 1-2 years), and their accent was much less severe. These were younger docs, who in my opinion, made an effort to get with the program if they want to practice medicine here! I do believe that people can actually make themselves hold onto their accents. I have a friend who is from the south (She has lived near me in the SE part of the country for 20 years) and she continues to have a strong southern accent. She has not lived in the south since she was a small child. I tease her about it.

This may depend entirely on the MTSO, but as an SE with MQ, they did in fact withhold federal taxes for me, (but not state taxes.)
So, a federal law
for payment of overtime only applies to whatever hours the facility or company defines as overtime; not all based on a 40-hour week?
They told me their cpl included spaces at hire but when I got the first check

My paycheck was 10% less than I billed, and when I told them I didn't get paid what I invoiced, they said they never pay for spaces and never have and never SAID they did .....  Liars.  I had to stick with them after that because it was my only job at the time (but I definitely started looking for another company after that).  THEN another time, their payroll girl went on vacation & they said we wouldn't get paid until she got BACK, about 10 days AFTER scheduled pay date!!   Paychecks were occasionally late, also.  I would NEVER recommend them to anyone.  Ever.

If the federal government checks the time the employee is producing work from the company software instead of the falsified time sheet and finds it is consistent across the board, the company will definitely be in a huge amount of hot water.  I don't work for them and never have.  I have my own small company with just me and two more employees, but if this is going on, the employees would have a firm case.  They should also document the calls or even record them when they are called to work extra.  Just my two cents.  I hope this helps. 
If you are an employee, they have federal
guidelines to follow to ensure you make at least minimum wage and to reference for overtime purposes.

Clocking in/out does not necessarily mean a loss of flexibility. It does mean some accountability, though.

You can go on line and get the Federal
forms from the IRS. I never did state, they were never that much anyway.

I am not an IC at Transcend, but I do some IC work in my local area. All I needed for this was to get a business license in my city of residence, for a home-based business. It costs me $26 a year, but I'm sure that will vary widely depending on where you live. (And that fee is tax-deductible.)

That's all it takes to become an 'established company,' to the best of my knowledge. Instead of a W2 at tax time you get a 1099.

Just call your city hall and ask them how to get a license to set up a home-based business.

If you have a home-based business you can write off all your computer equipment and repairs, and if your accountant is savvy enough, you can even take the home office tax deduction. Mine told me that is no longer an audit red flag because so many people are telecommuting now.

and labor board guidelines regarding employment of independent contractors and the difference between IC and employment status.  They cannot have it both ways...have their cake and eat it, too.  They don't want to pay taxes, Soc Sec,  and benefits for MTs.....but they still want the same control over the MT.  Same mentality of most MTSO's....insulting our common sense & intelligence bec. they've soooooooo smart and we're are, collectively, soooooooo dumb!                            
Several years ago, they passed a federal law
That law says that companies with over a certain number of employees have to provide advance notice (I thought it was 30 days, but maybe it's 60 days, I dunno)before just closing up shop and doing mass layoffs.

I do NOT think that law would apply to smaller transcription MTSOs with fewer than 50 employees or so.

It would absolutely apply to Medquist, though!

Although my job has not been displaced, I can emphasize with your predicament.  I have seen the decline in pay and benefits as a direct result of offshoring and only being able to find a job with a MTSO who stands against offshoring by sacrificing about 30% of what I had just 3 years ago.  Now I have custody of a 2 yo and because I make just barely above the 200% poverty level, I do not qualify for goverment benefits that I have been paying into for the past 30 years; however, because of certain federal funds being administered differently at the discretion of different states, I could move to a different state and the 200% limit would not apply to me!


In researching what benefits ARE available to me, I found the website I have linked below.  There are benefits available to persons who have lost their jobs to offshoring but I would like to point out one thing:


ONE of the programs requires that at least 3 OR MORE persons having been affected apply for the benefit.  So please for the sake of each of you that are going through your own crises, band together so each of you can find a solution that works for your own needs.  Please leave the ability to email each other in your posts so you can network.  You need each other's support now more than ever!  Find out what you CAN do for yourselves and for each other.  What have you been paying taxes for all this time?  You deserve whatever benefits you can obtain...you have already PAID for them!

Overtime is calculated in Elabor, in compliance with federal law....
We enter our hours into Elabor each day, and OT is calculated. Right now, with a slow workload, I doubt overtime is approved. As a matter of fact, it is not approved.

MTSOs have a unique loophole in the FMLA Federal

MTSOs have a unique loophole.  I got caught up in it a couple of years ago when trying to use medical leave for my personal medical illness. 


Here are the Federal Requirements:


 


 EMPLOYEE ELIGIBILITY


To be eligible for FMLA benefits, an employee must:


• work for a covered employer;


• have worked for the employer for a total of 12 months;


• have worked at least 1,250 hours over the previous 12 months; and


• work at a location in the United States or in any territory or possession of the United States where at least 50 employees are employed by the employer within 75 miles.


 


The loophole for MTSOs is the last one …”50 employees… within 75 miles.”  MTSOs can interpret that to mean “50 employees who WORK FOR SPHERIS” within 75 miles of EACH OTHER.  So, if you live in the middle of Wyoming, there may not be 50 employees within a 75 mile radius of your home.  Thus, the loophole, which some MTSOs actually do use.


HOWEVER, some employees do have a counter-loophole.  States also have FMLA requirements, and the State that you live in supersedes Federal requirements.  In my case my Sate does not have the “75 mile radius” requirement, so after I contacted my MTSO and informed them of that, they backed down and approved all the leave I wanted.


Check out your State requirements to see if they are different.  If they are not, if you can survive with 6 weeks and want to keep your job, I would not rock-the-boat any further.  Personally, I would use those 6 weeks to find another employer who is more employee friendly, if there are any left out there.

Are you always this bitter? Do you have a family and friends who are safe and healthy? Count your blessings instead of being so angry and you might see that this is not a bad field to be in. It has kept food on my table for 27 years and will continue to do so. Is it harder now? You bet, but it is not impossible to make a good living of $50,000. You just have to work hard, give it your all and appreciate the good companies that are out there.

If I were an MTSO, I would find out who all these people posting such bitter posts are and find replacements for them a.s.a.p. Negativity spreads like poison, and with the world in the state it is, we should bond together not make it worse.

and you don't have to be asked. If you work it, asked or not, they have to pay time and a half OT rate for hours worked over 40 in a week.

Taken right from U.S. Dept of Labor -
An employer who requires or PERMITS an employee to work overtime is generally required to pay the employee premium pay for such overtime work. Employees covered by the Fair Labor Standards Act (FLSA)MUST receive overtime pay for hours worked in excess of 40 in a workweek of at least one and one-half times their regular rates of pay. The FLSA does not require overtime pay for work on Saturdays, Sundays, holidays, or regular days of rest.

Extra pay for working weekends or nights is a matter of agreement between the employer and the employee (or the employee's representative). The FLSA does not require extra pay for weekend or night work or double time pay.

They must deduct FEDERAL taxes.. NOT STATE taxes.. if they took out state taxes.. it would be FLORID
which would only have to be refunded to you for you to pay YOUR state what you owe them which is nothing but a pain... be glad they weren't handling your state tax.. and I think in this case.. if someone at the IRS told you they have to deduct YOUR states taxes.. it is that person who is uneducated... they only have to deduce federal income tax

I only made 7.6 cpl and that was clinic transcription (with 6 years experience at that). I was told there were no raises per se, but would be eligible for bonuses ($100) a time or two per year. That was earlier this year. I didn't stay with them long because more money came along.
If $184 for self only, that is a LOT of money.

More Money?
I thought I posted this a couple of days ago, but now that I'm looking for it, I don't see it.  Anyway, I'd like opinions please.  I've been working for a small MTSO for almost a year.  I love the company and the work.  When I first started working for them, they told me up front that they will only pay so much per line because they are a smaller company.  I said that was fine.  It was not a bad starting rate.  Now that I've been with them for a little while, I feel like I would like to ask for an increased line rate.  Is that wrong of me to do since they told me up front they will only pay so much?

I've seen them put me on 7 different accounts Sat and today and put on bad dictators that just keep on coming.  That is definitely cherrypicking.  Just not making it with this company and have spent 6 months trying.  Need to move on.
