which would only have to be refunded to you for you to pay YOUR state what you owe them which is nothing but a pain... be glad they weren't handling your state tax.. and I think in this case.. if someone at the IRS told you they have to deduct YOUR states taxes.. it is that person who is uneducated... they only have to deduce federal income tax

Do they deduct taxes from checks?
I forgot to ask, do they take taxes and social security out of your pay checks or do you have to pay those yourself at the end of the year? Thanks!
If company is in state that has no state taxes
they are not required to take out state taxes.  It's enough to keep up with your own state tax law code, could you imagine having to stay abreast of 49 other state tax codes?  The cost would be huge and ultimately passed on to us by lower line rates.  Regardless of who owes the tax, someone has to pay it.  Just a matter of convenience I guess. 
Medware and state taxes
I was told by someone in the IRS that Medware should be taking out state taxes in my paycheck, but nothing has been done about this, and I have to pay my state taxes myself. I don't know how they get away with this.
state payroll taxes
My previous job was in the payroll department for a fairly large manufacturing company. We had employees in about 18 states other than NC. We had tax tables from any state that we had employees, and we were required to withhold based on those tables. We did have one that did not require us to withhold taxes but it wasn't Florida.
No. You have the taxes taken out for the state that you live in.
If you do not live in the state where the company is located, that state income taxes do not apply to you--only the state where you live applies to you. You do NOT work in the state where the company is headquartered. Ask any CPA and just look at the website of the state. You should not have taxes taken out for a state you do not reside because you do not have to pay taxes for a state where you do not reside. You only pay for a state where you live.
Medware & State Taxes
Actually, this is a common practice for many companies and well within the law. They can't take out your state taxes in Florida, (a) because Florida doesn't have state income tax, (b) you don't live in Florida, and (c) it would be quite a headache when tax time rolls around and you have to claim two states that you work in, even though you actually don't. I have paid my own taxes for years.

Plus, Medware states in their email that was sent to me: At this time today, if you are considering employee status we DO NOT hold out (state) income tax. We are a Florida-based company and Florida does not have state income tax. This will need to be filed by you individually depending upon what state you live in and whether or not you have a state income tax.
They also do not withhold state taxes and
there is no way that is legal in my state as it is my state law that if you are employed by an employer outside the state, that employer MUST withhold state taxes. My state has been investigating them for awhile but I still don't know what happened with that, but I will ask.

Reminds me of another company who used to withhold money for our insurance premiums. Well guess what...when we needed to use our insurance, found out there was none! They too were reported (this was not MW), but all we got was our money back that we paid for the insurance. Sad huh?

These companies are pathetic and I have no respect for this industry whatsoever.

If you are employee and have state taxes, your employer should take out.
I reported a company to my state, who clearly defines on their internet site that if an employee lives in our state yet works for a company in another state that might not have state taxes (for instance, Florida), the company in Florida HAS to comply with taking out state taxes.

From what my state told me, they fined the company heavily for not having deducted state taxes. Check with your state first and see what the law is.

This only applies to employee though.
They take out for FICA. You are responsible for state and fed taxes. nm

I have never had a problem with an employer withholding state taxes except with one
employer. They say they do not have to but my state says they do. Just the fact that my state sent me back all their late fees because I refused to do the job of the employer tells me I was right in waiting to pay until tax time. That brought it to the attention of my state. I can't wait to see the get the penalty and interest my state will charge them. I know it will take some time for the state to research how many work in my state (and I know at least six minimally), so I will just sit back and wait. My state does not give money back to you readily. LOL High state taxes so when you get your late fees back, you know then the employer being fined is only a matter of time.

You are correct. The state that rules is the state the employee lives in.
My state laws has is spelled out in their Code. If another state does not withhold, they are fined heavily and if they don't withhold for years, their fines are pretty bad. I worked for a Florida co that did not withhold income tax for my state even after I brought it to their attention in the state code. They kept saying that they would eventually and never did. After two plus years and when I left, I made it known to my state all the conversations, the state refunded me all late fees they charged me and then said they were going after the company in Florida because they had many employees in our state. They deserved it. They knew better.

What companies Deduct....

I was just offered a job by a company as an IC. I almost took the job until I read in the contract that you will have pay deducted if you accuracy drops below 98%.  I am still new to this profession and was a bit nervous to take the job as an IC. I was just curious if this is a standard practice for companies to do this? I thought maybe that was why I got the job offer because they know I am still new and if I did mess up then they wouldn't have to pay. But, maybe I am just paranoid?

I did not test with them either, because they deduct
2 cpl if for some reason you do not meet TAT. I really did not want to work for a company who deducts from an already low rate, even though I doubt it would ever happen, but if there was an emergency or something, you just never know.

The company I worked for did not deduct for punctuation.  I believe in the AHDI guidelines there is no deduction for punctuation, unless of course it changes the meaning of a statement or something like that.  Alot of the commas are open to interpretation, but some QA people are really picky about the hyphens.


The companies do get paid by the lines, so if your accuracy is 98% they should not care that your line count has increased significantly.  I would say take note of what it is they are complaining about, and keep up the good work.  As far as running out of work, I would wait and see how often that happens.  Could it be another case of offshoring what is out of TAT?

another 2 cents a line for taxes etc., and you need to have unlimited long distance. I wouldn't touch this with a 10 foot pole, 5 cents a line is not going to pay my bills no matter how big my expansion file is.

NO, you are wrong. They deduct half of the 15%
the other half.  So 7.5% is deducted from your check, then they pay the other 7.5% themselves.  My company does not withhold any federal or state taxes, only 7.5% for SS and then Medicare tax.
To be specific, how they deduct for headers
They deducted a flat 17% from the line count. You all know that all headers are not created equal and some have hardly anything in them and very few of them are 17% of the total lines typed. I remember when this head honcho went in one day and revised all the headers to make them with even fewer characters but that 17% did not change. I could not accept the politics of this company any longer and immediately started pounding the pavement for my own accounts because I didn't need the benefits anyway. This company was not Transtech by the way. I don't know what percentage Transtech deducts because I have never worked there.

Not when you have so many accounts and no work. How do you like the picky nothing stuff they deduct
off for the 98% QA. I have never seen such BS in my life. It makes absolutely no sense at all. Has no bearing on what an MT can or cannot do. It is all designed to get rid of more QA people and to make sure no one makes the bonus. No doubt about that. Has anyone tried to discuss this with them or is that impossible.
My thoughts exactly. Need an IC job so can deduct equipment, etc without having to meet 7.5% rule.
My normal company gives garbage as equipment, and I can't meet the rule for unreimbursed employee expense because I'm a high producer and don't have the other expenses that you can add to it.

I worked there for almost 2 years and there is no refusing mandatory OT. If they say OT, you work it. It was usually 1 or 2 hours a day.
If you would still refuse to get SM
your CMT after you've seen it's slowly becoming a requirement, then the only person who is keeping you from your livelihood is YOU.
Let's refuse to do it!

I have heard that companies pay the same whether it is VR or typing as well and I honestly think we should all just REFUSE to do it.  If nobody does it, what choice would they have?  They could of course recruit fresh newbies with no experience, but they would see quickly an MT needs good experience to correct and fix all of that junk that gets printed on there.

and you don't have to be asked. If you work it, asked or not, they have to pay time and a half OT rate for hours worked over 40 in a week.

An employer who requires or PERMITS an employee to work overtime is generally required to pay the employee premium pay for such overtime work. Employees covered by the Fair Labor Standards Act (FLSA)MUST receive overtime pay for hours worked in excess of 40 in a workweek of at least one and one-half times their regular rates of pay. The FLSA does not require overtime pay for work on Saturdays, Sundays, holidays, or regular days of rest.

Extra pay for working weekends or nights is a matter of agreement between the employer and the employee (or the employee's representative). The FLSA does not require extra pay for weekend or night work or double time pay.

Different state to state. You would be surprised to find

IC can be defined differently state to state.  Even the IRS cannot come up with a definitive set of rules.  You would be surprised how many ICs actually get unemployment in some states.  If the unemployment claim form asks specifically if you are an independent contractor, do not lie, but if it does not, do not volunteer it.  Let the company prove you are a true IC according to the rules of your state.  All you lose is a few minutes filling out the claim form.  I would only do it as a last resort.  If you can find work fast, by all means go for it, but the way things are now with all the VR and off-shoring, it is a backup if you cannot find work.  No one should go hungry because they are afraid to file for Unemployment as an IC.

I turn the stupid thing off when I am working because I do not want the distraction. If the boss has something important to say, then they can write or call, but don't think I was put on this earth so you can jot me little notes all day long.

You cannot live on that and i refuse to do it.
I have not done line pay ever and won't. Yes, I have bills to pay just like anyone else, but seeing my pay get cut because of the laziness of others (which I think is just an excuse--only a few I know ever abused hourly QA pay--actually not that many). Everyone I have ever worked with in QA no matter what company worked very hard. We worked together and I am telling you that if companies are giving you the reason that people abuse it, they are lying to you. They are just plain cheap and they found out that some companies got away with it so they are trying to do it. I said it on other posts, I hope they all go out of business because anyone who is worth their weight in gold will not take wages like that and the ones I know have all quit. We are trying to figure out what to do about it, but to be honest...we'd all rather do anything else but this in this industry that has no respect for any person alive.


If you refuse, you will find very little SM

work to do.  They'll tell you it's because you won't do VR, plenty of work there.

it unemployment can refuse you also. They don't care how much it is per line, that doesn't come into play.

There is a line though where you can draw a partial check if you make more than a certain amount.

Bottom line is, just because a company doesn't pay what you want it to doesn't mean there isn't work and that is all unemployment is concerned with.

insists you use their computer and YOU have to pay for it.  I can't believe MTs companies to do this.

Combined Companies Create Premier Outsourced Transcription Provider Heartland Information Services has merged with Spryance, Inc., forming one of the premier offshore transcription providers in the United States. consistently on both your primary and secondary accounts.  Then whatchagonna do? They're not real big on sharing work out of regions.

My family started a new business last year and I am just waiting for our client list to build and then I am jumping ship. No need to wait around until the worm turns when I could be making good money now, not siting around hoping that I will make decent money 10 years from now.
They have a couple of travelers that absolutely refuse
to take an assignment if there is a drug test. Now I don't know about you, but to blatantly come right out and tell the company you work for that you can't pass a drug test and give you another assignment that doesn't require one ... TAKES NERVE AND BALLS! But they allowed this.

This one guy (yes, a male transcriptionist) would take the rental car from Illinois and drive back to Shreveport, Louisiana just to bring back pot! And then had the nerve to charge the hospital/company for mileage. AND THE HOSPITAL PAID FOR IT!
I absolutely refuse to take long tests.
Maybe one dss file, that's it for me.  I'm finished typing someone's work for the day.  I feel like you are actually doing work for free on some of these tests.  They get your test, and then don't even reply back that you failed.  I would almost bet they are giving you their overflow.  Then all they have to do is QA it.  I feel like if they get a backlog they say, hey let's put it as a job offer.  We'll get bites, we'll have them do it as a test, and then all we need to do is QA it, and it is like they are getting us to type for free...  
I amend the contract or refuse to sign

I've been presented with a no-compete 2 times.  Both times when I questioned the employers for more specifics, the info I received from them went contrary to what the clause actually stated.  (I think they had just copied it from somewhere.)  I told them if they had a presence on the Internet, then their market was the entire world and that if I signed that contract as stated, it would mean I could not work for anyone in the world as a Transcriptionist for a year and there was no way I was going to sign that.  Both times the employers they said they did not realize this.  They just didn't want anyone stealing their clients. 


I refused to sign each one until I personally rewrote that clause stating specifically that I would not pursue any of their current clients, especially the accounts I was on, for a year after leaving their employ and that if I pursued someone but did not realize that entity was their client, I would not be held responsible (since I was not privy to their client base).  That was it.  Nothing more.  They were more than glad to comply and said they were glad I told them this and would amend that contract for future employees, as neither one of them wanted to prevent anyone from working.


I'd consider possible court costs if you take the severance and pursue work.  They might not win if it went that far but you'd still be at chance for possible hefty fees just to get the case dismissed and end up with less money and more hassle.  Your lawyer should be able to give you a figure on this.


 


I am with you and am happy to refuse low paying offers. However,
I know there are people out there who will continue to work for peanuts.  I am anxious to see how may responses you get to your post. Come on ladies. Let's do this!

It takes way too long. I've done this in the past, and as you've also stated, nothing came of it. I won't give them anymore free time. Any time I have, I need to use for my job search.
