Collection Agency Tactics??

Does anyone know who I should contact, or if I have anything to complain about regarding a collection agency out of Texas. I used to actually work for a collection agency 20+ years ago out of Florida, and we would NEVER have been able to say what these people have said to me via phone, let alone in a letter I just opened. Long story short, yes, I owe HSN $200+ for a computer I bought on a payment plan of $135 a month. Before I was done with payment #2, it broke, and thus began months and months of me sending this junk back and forth with Gateway. It was a lemon model, thus why it was offered for 5 payments on HSN. After I made payment #2 and Gateway had the computer for repairs more than we had it to use, I called HSN. In no uncertain words, the sales rep told me "you bought it, you deal with it". There were lots of reviews at this point on HSN and all buyers were furious, as it was junk. HSN quickly removed the computer and reviews. So, yes, I have been lax in paying it, but it didn't even last 2 months. At any rate, they throw me to a collection agency, who calls at least 15 times a day. I am sending them payments. I get a letter today that actually says they are going to "ASSEMBLE AN INVESTIGATIVE REPORT WHICY WILL OR MAY INCLUDE...INFORMATION AS TO MY CHARACTER AND GENERAL REPUTATION"... the caps and bold are their writing. It then goes on to say that I should send $$ immediately as they have "NO DESIRE TO CAUSE ME EMBARASSMENT"... Can they word things this way? I have never in all my life seen anything worded to this effect, as obviously, even though they use the word "may", it is a direct insinuation to scare me that they are going to ruin my reputation and are questioning my character, and threatening embarassment.  Seriously, has anyone ever seen this before? I don't have a lot of experience with agencies, other than working for one decades ago, and hearing horror stories on TV shows about stuff like this, which I could not believe! Does anyone have any thoughts on who I could contact?  I wonder if HSN knows this agency is saying personal stuff like this? I know companies just farm out their old debts to agencies.  Again, its a tough one for me to swallow, as the computer never lasted even halfway thru their 5 easy payment plan, but I have recognized the debt and am paying, albeit at $50 every 2 weeks. But this insulting letter was just the icing on the cake for me.  Do you think its legal?

Have you heard of the recent economic crisis? I'm sorry I had to go to the ER without insurance, but honestly, your doc saw me for five minutes and couldn't even remember why. I think $750 for laying on a gurney for two hours is pretty unreasonable. I didn't go there to buy his next Corvette.

If you ever call me at 9:00 pm again while I'm finally having a good nights sleep, I will find you.

Also, just for that, you have now been rotated down to the bottom of the list of people I owe. Pity, you were next in line.

Have you bothered to learn the laws governing your job? In case you had not noticed, people are getting laid off left and right these days.

I have explained to you for the last time that the bill you have called me about 12 times this week went on a bankruptcy filed and discharged 9 years ago. YOU CAN NEVER COLLECT ON IT.

When I am currently considering myself lucky to have a job at all and struggle to pay my bills, why would I pay you for something the Courts said I no longer needed to worry about?

Please leave me alone. Harrassing me will not help you keep your job and may in fact cause you to lose it.

Please stop calling my phone number looking for Dave. I do not know Dave. I am not related to Dave. I have never heard of Dave except from the last collections agency who kept calling me. I understand that Dave had this phone at some time in history, but I have had this number for FIVE YEARS now. Dave isn't coming back. If I knew who and where he was, believe me I would tell you so that you would stop calling me.

Anyone ever been sued by a debt collection agency

My husband and I have an account which we feel we don't owe.  We cancelled it within the amount of time we thought we had to cancel, but were later told the contract for services was not cancellable (a vacation timeshare).  The original amount was only $1,000.


Since that time, the timeshare company has sold our "debt" to a third party collection agency, Apelles.  They call at all hours and even on weekends.  Since I have caller ID, most of the time I don't even answer.  This morning, however, they called at 8:45 and woke up my kids.  I was a little annoyed, to say the least, and I'm just wondering:  Does anyone have any personal experience with this company.  I'm thinking about sending a Cease and Desist letter, but I'm worried that that will trigger them to take me to court.  Has anyone ever been sued by Apelles?  I would think our amount is too small to be worth their time and that they would just try to sell it to another agency.  Any thoughts?

Why don't you hire someone there to cut it - sm
maybe every other time or once a month to give you a break. My DH bought a $2500 tractor to cut our 5 acres(4 to cut) in the next county and has not done it once as yet, though he just had to have that tractor so he could cut the property He always has some excuse not to cut it. The tractor does get used on our 1 acre here at the house, but that is about it now (he used to cut the grass at a local church but no more). We have a local guy cut it maybe 2 x a year for $120 a pop. Obviously we are not maintaining it to look pretty. We have it cut it when it gets 2-3 feet tall basically. Last year we got away with only 1 time, not quite sure how we did that though.
Do It Yourself? or Hire Out?

Just curious--how much do you do yourself around the house?  When do you pay others to do the work?


When we bought the house in the country, the previous owner was telling me about: the guys who plow her driveway, her cleaning lady, and she offered to give me the name of her window cleaner. 


We don't pay others to do what we can do ourselves.  I do the: cleaning, gardening, window-washing, painting.  DH does the lawn, small repairs, clears the driveway, etc.


Only time we pay someone else is when the job requires more expertise than we have--for instance having the heater repaired, or major electrical work (DH can do the small stuff).


I even ripped down the 4 foot stockade fence in the back yard, tilled my vegetable patch, dug up some medium-sized bushes, etc. myself.


So, how much are you willing to do? where do you draw the line?  Why?

an honest, trustworthy Financial Advisor, who happens to be my brother's best friend of 25 years.

That is true but the owners who hire them
should be held accountable. The American roofing/contruction co owners that do not want to pay their share of tax or pay a descent wage to a legal worker should be held accountable. The immigrants working illegal are just trying to make a living. (Yes it's stealing and wrong and I do not approve. Especially when they bring their whole families here.) The owners of these company are the real cheats though. They buy big vans and pick them up and drop them off. It's horrible wages are so low for hourly workers now. :(

who is now 15 to babysit my 2 (7 and 8). She has 2 younger brothers (6&7) so plenty of experience being around younger kids (plus her mom is right up the road if there is a problem). I pay her $5/hour and usually a $5 tip to boot. Kids have a blast with her too, so it all works out.

If you live near airport, airlines hire seniors for customer care type activities which vary and you get flight benefits.
All the kids should pitch in to hire help. Shouldn't all be on

I'd still hire a local general contractor.

Whether modular or traditional stick-built, there are a million details, legalities and regulations involved - and you'll likely still need some local subcontractors.  A good general contractor can save you a ton of grief and bad experiences.


It is o.k. to hire firends to do the work cheaper,
but this lady is crazy! Do not give her any money, a deal is a deal and the husband is happy. If she needs some money, she should ask her husband for it.

Well, in a bank he would be handling money, so I think it's a legit reason to not hire. sm
To me, it makes perfect sense to not hire someone based on poor credit when that person would be working in an environment such as a bank, handling funds, etc. I see less reason to do so in other jobs, but in a bank, sure, it seems only logical to me. Sorry.
Make your own income, hire a plumber. Total unnecessary. Men are useless in the family plan.

Life is way to short.  I had a stepmother like you.  Once I lost my mittens and it was freezing outside and I had to walk.  This wench actually got in her car, found me on my way to school in a snow storm and took the mismtached pair that I had found in a box.  She was an awful woman and I never saw her again after I was 16 and left the house.  I hope she has as miserable a life now as she deserves.  Don't be a petty witch with your children.  They will resent you in the end, may be even slash your perfect tires....

Glad I did it

I never went to the ER (I have to be almost dead before I go), so I suffered about 4 episodes before I went to the doctor.  I didn't know what it was.  Each attack got worse.  After the last one, which was horribly painful, I went to the doctor,and didn't hesitate to get surgery done.  I had a "rock garden", the tech called it.  It was PACKED with stones!  I had to wait almost 2 months.  I was so afraid to eat I lost 12 pounds in 2 weeks!  No exercise either!  THAT was easy! Having never been in a hospital before as a patient, nor even having had any kind of procedure, the anticipation of the surgery was MUCH worse than the procedure.  But I was a healthy person with no previous surgeries.  I had almost no pain after, and took it easy.  I went back to work after 3 days.  I don't know what the risk would be with your recent surgery.  It's something to talk out FULLY with your doctor. 


You'll make the right decision.

Was your dad in the picture, by the way? You said it depends a lot on the parent, which is true, but it seems you did well for yourself on your own without much help from your mom. I have always believed that kids are born with their own set personality and demeanor, and that the parents can help foster good kids and teach them right from wrong along the way. Seems you were born a good seed.

this is the only thing I miss about an office setting - someone always knew answers when I didn't.  Home Depot, here I come!  I was going to build chicken wire cages around them, but it is chipmunks that won't help either. 
I had them done and am glad I did...sm
In high school I had allergy testing done which showed I was allergic to dust and mold, and we were able to control my symptoms by making changes around the house to cut down on these (i.e. plastic mattress and pillow covers).

A few years ago I developed other allergic symptoms and had food testing done which revealed that I have 3 allergies to chemicals in foods, and once I eliminated those food sources the problems went immediately away.

Good luck to you. Not everyone who has allergies needs allergy shots, but if you do they should help you. Even my dog had allergy shots and they helped her significantly!

I also have to remind myself I have it because I am fine. Sometimes I wish I didn't even know about it! I only got tested because I knew I was at risk. So you have had it about 8 years or so longer than me, and still doing great so that's really good!

She'll definitely know when she's ready. I had posted before that I had lost my cat back in March. I'm still not over. Like one of the other posters, before she died, I think she had a stroke. She died at home. Just be there for her. On her last night I told her it was okay to go, and she must have listened because she died a few hours later.

I am glad you had a nice heart-to-heart discussion with her. HOpefully, this opened the door to many more conversations and it sounds like may be her friends feel they can be honest to. I just hope you can get rid of this loser and hopefully she can stay away because my concern is if she wants no more will he except that. HOnestly, i hope she is not just saying that to make you happy and I don't know her very well so who am I to say. It sounds like she is being honest with you. This was her first time correct? If so, it sounds like she realized what a huge mistake it was. People, who are you to critize her for having this guy looked into. If you had the resources you would to! I know i definitley would. Well hopefully she will listen to her brother and I would stay out of it and act like you know nothing and see if she will come to you and talk to you about it. Hope it all works out for ya!
