I don't know the legalities, but my ex was simply too lazy to go to his HR department and ask them to take me off, so I was left on his insurance for years until he got remarried. Worked out great for me & paid for a $14,000 ear surgery!

The only way you're going to be taken off the policy is if your ex specifically requests it.
