| Yes they can ask, but that does not mean you have to -smPosted By: XXX on 2006-08-03In Reply to: IC being asked to work OT weekends - IC in overtime

I work as an IC but most of us here work nights/mornings, so our work comes in later in the day. So that means we have weekend work, unless you only want 4 days of work. Now we can take off if we want, just need to give them some advanced warning (a week or two), no calling up an hour before you work is to come in and say, sorry, I don't want to work this weekend....screws up their whole schedule/TAT. As for OT, no, you are an IC being paid a flat rate. If they have you working a set schedule then you are not considered an IC by the IRS. I do not work a set schedule but have to have the work given to me in by a certain time the next day. I can refuse work, but again they (my MTSO) would like some notice which I do not think is unreasonable. They are trying to run a business and that business feeds me. If you don't want to work weekends don't. But if you want to be nice and help them out now and then, say 1-2 x a month, then do so. IF they keep asking you to work the weekends you can always say fine but I want 1 or 2 cents more a line for the weekend work, and get it in writing, and bill them accordinging. Good luck.
