After my ex husband and I got divorced, he tried to claim me as a dependent still, because he was paying a minimal amount of support, even though I had worked that year and had my own taxable income. He had made our taxes a part of our property settlement and had filed for an extension to pay. After having waited for over 6 months for him to get his stuff together and get our taxes done, I was so frustrated with the whole thing, that I just signed the papers to file. I did, however, send along a note to the IRS stating that I was signing the papers because of such an elapsed amount of time, but that I did not agree with the way they had been done, and did not feel that he could claim me as a dependent. Well, they sent me MY portion of the return, without question, or any communication with me, but they began an audit on his taxes for five years previous to that. At the last communication I had with him, which was over three years ago, they had gone back three years at that point and had determined that he already owed them 5000 in back taxes. I have never heard about the other two years. Of course, with me having been married to him, he said that it was my debt as much as it was his, and I agree with that, however, since he was the one doing the taxes for all those years, and his idea to try to cheat the govt., I told him that I had paid my portion of the taxes, which I had, and anything they determined he owed, was on HIS shoulders, not mine. So, now he and his new wife have to pay his *mistakes* back. You just don't mess with the IRS! It may take some time, but they will catch up to you. I ALWAYS pay my taxes and I am honest about what I have earned, 1099 or not. It's just not worth it to try to save a few dollars.
