The physician must have you sign a document that they can share your records with researchers.  If you don't feel you would ever want to have your recrods sent out to researchers, you must tell the physician in writing on the HIPAA compliance notification document that the physician is required to give you the first time you are seen and also updated at subsequent visits.  Patients have the right to opt out of their records going out for specific purposes if they don't want them to.


Now if you opt out of allowing your records to go to your insurance company for any reason, I don't know a physician who would provide any services to you as those records support their claims for payment of services.  And if you name is not on the intake record, it violates the 1995 and 1997 documentation guidelines.


Everybody try not to get jiggy over this.  It just isn't healthy living.
