If so, I did not have to sign anything saying I would not work elsewhere while working for them.

Didn't you guys sign a contract stating what and how you were paid?
m,
Have to sign contract and
have to give a month notice if I do not like it, or feel it will not make enough money. It is user friendly and can use expanders.
First of all, did she sign a contract?
If you did not have her sign a contract, then you can just let her go with no notice.  If you did have her sign a contract, then just give her a reminder of what is expected of her as stated in the contract.  This is why contracts are so important.  It gives you something to stand behind your expectations are not being met.  As a professional, you can't just keep someone on because you like them.  You need to have someone you can count on even you don't particularly like them....  JMO.

If not, then just take it as a learning lesson - that your fill-in decided to compete with you, and more importantly that your client decided to keep you both.  Your PT office may be naive to it all.  However, consider, if I was the PT office, why would I tell my MT to get a fill in, then decide to keep the fill-in and my MT?  Unless business is booming and there is plenty of work for everyone, I would take it as a slap in the face.  I hate when docs offices do this.  Personally, I'd confront my fill in and the client about it

Yes, of course IC's have to sign a contract.
Independent Contractors always sign a contract, to my knowledge. I have never taken an assignment without a contract.
Yes they can if you sign the contract.

For next time: Don't sign a contract like this. SM

You should be paid no matter what. Insanely crazy that some people think your pay should depend on theirs!

1) do you have a contract stating line counting and line rate,sm
if you look at the IRS website it's pretty clear what constitutes IC versus SE versus employee. You might want to photocopy that along with a copy of your contract with your next invoice and also put on the invoice any monies due from past invoices they "changed"...maybe catch more flies with honey than vinegar. Good luck!
When a company advertises a sign on bonus..sm

should I take this with a grain of salt?  Like, you must be with the company for a year or produce an outrageous amount of lines before you get it?  There is a company on mtdaily.com stating they will give $1500 bonus for acute care.

Thanks

I didn't sign up for it, was begged to do it when company was in need. sm
I try to do everything asked of me for those who pay me and somehow don't know how to say "no" when I am asked to do something. I was begged and I caved in and agreed.
The company I contract with always sends something....
MT week they usually give some thing cute with their logo, pens, note pads, mug, travel mug, a mouse pad, etc. Christmas most usually is a snack food in a tin, always yummy, cute and appreciated. :-)
In contract, but soon ending wih company
Actually the 'lady' I have been subcontracting work from never had me sign anything from the get go. She is 'old school' and, at first, this really troubled me but no contract was ever entered for me. I have been doing work for her 9 months now.

The doctors are not located near her either. Thank you for the advice. I would never want to be labeled a client stealer. I know that a lot of this has to do with that I have been doing the majority of their work for some time but they were just made aware it was me since I was made to contact them directly while my boss was on leave. When I do not work, others were given this load and the doctors were never happy. I created the template for the new partner and he likes it best. I have never divulged any of this to them but I think they are just figuring it out since I have had to contact them directly for the last two weeks. It is a touchy situation and it makes me feel flattered but, at the same time, apprehensive. I do know these are reputable, well-meaning, doctors.
Better read your contract with the national company before doing that. sm
Most companies have you sign a non-compete agreement. So, you can not solicit their clients for at least 1 year after your termination from them. Some companies do not have that agreement. You need to read your contract before you go down that path.

Good luck!

I'm not sure how contract for deeds work

as opposed to traditional mortgages.  Go to Google.com, type in

to see what comes up.  They do still have to follow certain legal procedures when foreclosing, but I just really don't know what your state law is.  Keep trying to contact him to explain your situation and ask if he'll work through it with you.  Send him a certified letter if need be.

contract work for hospitals
I have talked to quite a few people, and I have found that subcontracting work from a hospital pays way better than even having your own accounts..  do any of you do contract work for a hospital?  I work at home for a hospital as an employee, get paid by the hour, plus incentive on line count.  But, I am wondering if I would be better off to try to do all the work as contract and make more.  Sure, I would lose benefits, but would it be worth it in the end?  Any thoughts?
Contract work for hospitals

Hi Sammy,

I envy you.  I am looking for a home-based Pathology job, and would not mind your setup at all.  I need the benefits, so that is why I am currently working at our local hospital, but plan to retire soon.  Does your hospital need anyone else?  Please e-mail me.

when you work for a national, you sign a confidentiality agreement...?
the same rules would apply, and you must have signed a confidentiality agreement with whomever you work for. you can be fired, if breached.

my opinion, as a professional, you transcribe it and mums the word...

when I worked in a hospital, someone was caught 'sharing' information about the CEO from a transcription report, and was fired on the spot.
But I have seen job ads that say the contract prohibits the work being offshored. So, there are

You don't want to work for this company. Call your current company and
tell them that you have decided against the new position and tell them that you would like to stay. It is cheaper for them to let you stay than to train someone new. A company who could be so tacky as the one you just spoke of is one you do not want to work for. You can rescind your resignation. If you are a good MT, they will be glad you did.
All I know is it caused the company I work for to be unable to do all work due today and the rest

i used to work for a company that divided the work types up and i loved it. sm
there were only 4 of us working a major teaching hospital. someone was assigned surgery, different assigned discharges, different admits, etc. we all had the backup work type in case the original assignee wasn't available and were cross trained. it made us much more efficient, ability to get used to dictators, set macros, and in the long run we were all much happier.
The company I work for said cable phone wouldn't work, just FYI.
nm
That is true, when you sign up you sign up from the
day your former insurance terminated. Then it is on a month to month basis.
I don't work for MQ but that happened to me once at the company where I work and
my next two paychecks were shorted out of what they had overpaid me for that pay period. I hope they don't take it out of your hide. It was hard to budget for that month!
Company I work for has to pay fines for work out of TAT.

I work as an IC, work when I want, but I still let the company know if I am going to be unavailable
for any length of time, even though I don't have to.
Contract/no contract -- same rights
You do not have to have a written contract to take them to court.  All you have to do is to prove you have been providing  work to him, past statements/invoice will do that,  you just fill out the small claims forms and go to court.   But first of all I would personally go in and talk with someone about it.   Could be the office manager/bookkeeper and not the doctor that is not paying you.   He may not know anything about it.   And please do not  make the "joke" as above mentioned, that is very LOW class, tacky and not professional at all.  Especially if you are in a small area -- you need to conduct like a professional.  But call and make an "appointment" to talk with the doctor either in person or through a phone call.  Some doctors do not know what is going on in their office and perhaps the office manager wants to be paid first.  If the doctor does know, then in person or over the telephone inform him that you have no other choice but to pursue the debt just as they would if someone did not pay their bill and if that involves going to small claims court, then that is the route you must take.   Good luck.  I did take one to court without a contract and won.
That is not what the OP is stating..

If the company is advertising for "shifts" meaning 7 a to 3 p, then that is an employee that they need, not an IC.

ICs choose their own hours; yes they do.  Anything dictated by an MTSO for shifts meaning the MT must be accountable for those hours equals EMPLOYEE, not IC.

The OP is absolutely correct.  These MTSOs take advantage by instituting a shift or schedule.  As an employee, that's great.  The reason behind the MTSO doing this is that they feel they can just not hire the employees which cost more money and get away with not paying the taxes.  So many MTs fall for this scheme.

This is the whole reason you see posts about companies that hire ICs and then ICs are on here complaining of no/low work and there is nothing they can do about it.

Such a shame not all of us are smart enough to see this racket, which is what it is a "racket."

Kudos to MTSOs who hire employees.  Bah Humbug to MTSOs who hire ICs and then dictate the hours or shifts to that IC.  When in fact an IC equals self-employed which means I make my own hours.

No. They start out stating how (sm)
great they are to work for. Okay so I decide to try them. Everything goes along fine for about 6 months, then it hits the skids. I have concerns how they suddenly switched my accounts with no word as to why. Then they stop sending work altogether. I emailed the main lady, my supe, and even the CEO of the company all to no avail. I then get a very rude and threatening email from them about how I have ignored them. WHAT?! I did not ignore them, it was the other way around and when I called her on it, she shut up and quick. Unfortunately, I am only one of many who had this experience with this company. They tout themselves as the best to work for, but are far from it. It was about the worst exp I had.
Just stating what I see, sorry if your toes
stepped on. I guess you must not read the others.
Some people just don't like the truth. A lot of the vents are from "supermoms", so impressed about that, who apparently do not feel like they can do it all, otherwise why be so frustrated?? How do I make time for this, how do I take care of the baby and still work. As far as not knowing what it feels to be cared for, as far as my hubby up is concerned he has me on a pedestal. I worked and kept up as many as 6 other people before and I did not go around crying and whining. I did it because at that time it had to be done. Just part of being a working person, just did it, no crying and no whining, part of life. Now hubby pays for the house, my vehicle and says if I want to can quit working whenever I want. Just try to read the posts, ok?
I am stating how I feel about something
and I do not have the same opinion maybe as you or others but it is my opinion. I do not know of anyone who puts themselves in my shoes so don’t know where that goes. Actually have more of an open mind about lots of things, very liberal type person, just do not think this is a really big deal. If you do not have names, addresses, etc. etc. how in the world can you do identify theft. Use your common sense, ok?
for stating that!!! Finally! NM
nm
You could try just stating in a letter

They may or may not decide to keep you.  You don't really "ask" as an IC.  You "state" as an IC.  You will risk them finding cheaper services.  So, you need to ask yourself if it is worth losing the account for a few more cents per line.  The only other thing you could do is attach an "administrative fee" to each bill and let them know it is for tasks not related to the actual production; this would be a little raise.

The bottom line is that raises are nonexistent as an IC.  Normally what quote you've given them in the start of the work is what they expect to pay or they'll find someone cheaper like an offshore company.  I wouldn't stir the waters if I was you, but that's just me.

I tried to barter with one account over a raise and the doctor met me halfway.  I was being paid per page.  I had to drop him though because once I raised the rate, he quit paying me on time.  I guess I was last on the list.  He switched to me doing handwritten note dictation (no dictation).  It was hard on the neck and eyes, so I quit.

Well, I WAS stating my opinion.

not trying to be nasty, just stating sm
a fact. Too many MTs out there without sufficent education and they are suppose to mess around until they "realize" that they don't have the education?

I have seen schools make promises to these people that they can't keep. I have warned people not to put their money into these schools and most don't listen. Have actually had people call after they "finish" school and tell me that they cannot or could not transcribe the tapes given to them on a final examination.

Sure wish folks would listen. This is not a career for folks to walk into hoping to be a "fast learner." I wonder if your doctor is a "fast learner?" This kind of attitude has brought this profession down to nothing more than a typist.

work for a company

When work is low at my company I have

volunteered several times to just work half a day, or take the day off so that another MT who needs the lines more than I do can have the opportunity to at least get in a full day of work.

I don't often have a day where I can't get all my lines in though and there are usually lots of days where I could type 24/7.   My work is assigned to me and I have no idea what any MTs workload may be on any given day.  Most of the time I work extra if the workload warrants it, but there are days too that work may be slow at the beginning of my shift and I'm just not able to work more later in the day to make up the lines.  I'm not complaing about not getting work, but I also don't believe that I need to fit my life and family around my work on a regular basis.  I believe that when an MT is hired FT and the company has expectations of how many lines a day they want the MT to produce, then it is reasonable for the MT to expect work.  I know the business is feast or famine, but if an MT who if FT and wants to work is consistently not getting enough work during their scheduled shift then there is a problem.

I'm very good at what I do, but I work to live, not live to work, and I don't remember signing anything that said I agreed that my life/family came second to MTing.

Any company that has work right
x
we must work for the same company
The little scale at the top of the page actually calculates total lines, but we do it separately I believe because of keeping track of what each MT does on the log. I keep the log up and type it in as I go and don't fool with writing it down.
Who is the best company to work for?
Can someone please tell me someone you work and are happy.  I have 8 years' experience in multi-specialty clinic and acute care (except op notes) and want somewhere with good pay and steady work.  I'm tired of bouncing from company to company after they lose your account and don't have enough work to keep you busy.  HELP!  I am so frustrated with this field.  When things are going good, I can do 2000 lines a day and be happy, but then every 6 months or so things go bad with that company and its a few months of transition after things fall apart.  I'm about to lose my mind.  Thanks in advance for the suggestions
