In Reply to: I think the employer is being unreasonable - Another IC opinion

If you are a true IC, the doc's office does not dictate to you the hours you work so if you need a vacation, you take one. If you hire an IC, it's none of their business because it is YOUR business you are running.

In your earlier post you said that they wanted you to be IC status so they didn't have to pay bennies, etc. They are the ones who want to have their cake and eat it, too, and it doesn't work that way. If you want time off, you take it. If they MUST have the work done while you're away, they will have to allow you to make whatever arrangements you need to to meet that need--this is the responsibility of any business owner. How you get that done is, again, NONE OF THEIR CONCERN. If, however, they can wait, then you need to decide whether to allow the work to wait until you return from vacation or make arrangements for coverage so that you don't return to a backload--that is your decision alone to make.

If this office is trying to control how much time you take off (apparently, none), then they need to either reclassify your status as an employee or allow you to run your business as you see fit. You need to have the backbone (meant in the nicest way) to do what needs to be done as a business owner, if that's what you want to be, or be willing to change your status to employee--either with this office or another employer.

Unfortunately, some of the responders to your original post have not been very kind to you and in your burnt out state, it's hard not to take their remarks personally. Bottom line, you and you alone decide what the next step is. You will have support here when you make your decision. Keep us posted on how it works out for you.
