If you are referring to me as a vulture, I beg your pardon. I am not an unscrupulous vulture for vulnerable MTs. The company I was referring to is a legitimate company and no, their conditions are not horrible, and NO, I am not making any money on referrals. I no longer work for the company and I am not phishing the boards. By the way, isn't anyone looking for a job and filling out an application a complete stranger to the company? I am not conning anyone.....I no longer work for the company as I ended up with way too much work with my initial accounts and I let that work go, so I thought they probably are looking to fill some positions. I will not be getting a bonus or referral fee of any type, just trying to help out someone looking for PT work.

Sorry you've had such bad experiences but you need to get over yourself.... everyone isn't out to get you!

AND, I didn't send any private e-mails trying to snag someone.....they sent me one and I will definitely try to help them if I can.

You’re half correct. What you would become is a statutory employee (SE), not a “regular employee,” like you would be if you worked in an office. In the case of the SE, the company and/or individual they provide service for would be required to pay 7.5% of the social security tax, but that’s as far as it goes. You would still need to withhold your own federal tax in addition to other taxes like Medicare. Furthermore, and the law used to state that anyone who works exclusively for a single company/individual is classified as a SE, by law.


 


The 20 guidelines I posted here and on the Main Broad are merely a framework. Each individual should speak with a lawyer who specializes in Employer/Employee law or directly with the IRS.

I don’t agree that (all) MTs are convinced it’s okay. They’re simply not fully aware of the laws, or they know the laws but feel they’re stuck “between a rock and a hard place.” Either they “agree to the terms” (of the contract) or they won’t be able to pay their bills. But, it’s still the element of control and the MT *still* has the final say:  “I agree to the Tues-Sat shift for 8 cpl.”


 


There are two other issues that come to mind. First, the line rate. An IC determines what constitutes a line, and informs the client accordingly. Usually, they choose the software they wish to use (i.e. Sylcount), but sometimes the MTSO will tell them, “We use Abacus and count spaces and returns only; no formatting codes” and that’s okay. However, if you have IC status you should NEVER let the MTSO do the line calculation on their end and then tell you how many lines you’ve transcribed. Doing so gives the MTSO “the element of control,” which makes you their employee.


 


The second issue is a little trickier and it concerns the “application process.” Again, what applies to the IC also applies to the MTSO. When the MTSO approaches a client (i.e. Osh Begosh Hospital) to offer their service, they try their best to sell their service and secure a contract in the process. They do not fill out a job application nor do they take a transcription test. That’s what an employee does, not an IC. The IC provides references, and that’s it.


 


In the final analysis, knowing the law is one thing and adhering to the law is another. You can tell the service what the law is, and they can just as easily tell you that your services are not needed. And, unfortunately, that’s pretty much where it’s at right now and where it will continue to remain.

Beware of Helpful Posters and MTs pushy to refer
Regarding post below, it reminded me that I have been meaning to post something, but just have been so busy.  It stemmed originally from the recruiter discussions of late, and their credibility issues at times.  Even more than worrying about recruiters, please be very leary about seemingly sweet and helpful posters who reply to you on here and then send private emails about jobs they know of that can help you out.  I swear, in the years I have hung on this board, and in the days when I used to be trusting and naive, I have never once been contacted personally by anyone who was trustworthy or had my best interests at heart. I have run into the really screwy companies via these supposed helpful posts, and these are the companies who don't pay, are very dishonest and/or shady, etc.  I won't name names, but many of these helpful posters are well known, and also recruiters fot the shady companies with less than above-board business practices.  I just hate to think of the innocent new posters, truly looking for help from their fellow MTs, getting sucked in by these unscrupulous vultures.  These vultures peruse these boards 24/7, looking for vulnerable MTs to pounce upon.  By the time you realize you've been conned, its too late. If they just happen to know a job that could just happen to help you out, chances are more than good that its a skanky company - otherwise, they wouldn't be phishing here for victims. They'd have legitimate advertisements on the many MT job sites.  Also, please keep in mind that many happy employee referrals, who also happily email you privately, are simply 100% looking to make a referral fee. Their company may be a nightmare, with horrible conditions, but these vultures make up the $$ by phishing these boards and referring literal strangers to their company. Referral bonuses range from $300 up to $1000 at times, so you are nothing more than $$ to the helpful person, who is just looking to pad their paycheck, not help your situation.  I know I was conned several times over the years, or at least stuck in very uncomfortable situations, and hopefully will spare somebody going thru the same. Remember, too, if a company is that bad that they have to have MTs referring and recommending complete strangers, there is something wrong, with the MT and the company.

I get stressed with the 95% ESL too

and work types that I don't like to do and wasn't hired to do (course I wasn't hired for the 95% ESL either).  One day I can handle, 2 days back to back is too much.  If I was paid hourly it would be different.  I start looking for jobs, send out resumes, post resumes ....   I interview, test, ace the tests, everyone is anxious for me to work for their company, but they don't pay squat, I have to punch a clock, do xx lines, etc.   I've done this 3 or 4 times the past 5 years and finally decided there just isn't better out there and on the bad days I just need to take a deep breath and keep plugging away.   I make good money (not as good as you) but I have to really work to get it and I can't imagine doing this job for any less than I currently make.

I think it began with taking over another company a few years ago and acquiring their Indian facility. Then trying to change the whole company over to Cornerstone, losing some of their business, introducing VR, low work volumes, many MTs unhappy with the new compensation  ... and  acquiring CHS.  On my last account their, manager said the facility is complaining about too many blanks...then said use the blank more often and produce more.
So sorry you are stressed! I've been with JLG (also from MQ) for a while now
and love it. Maybe you should call and talk to someone there and they can help you out. Good luck to you!

Thanks. I'm a bit stressed after reading the handbook. It looks
very cumbersome and I'm afraid I won't be productive, but I have worked on the account for 5 years so I'm hoping knowing the dictators and their quirks and the account specifics will  be enough to help makeup for learning a new platform.

Last week made good lines, good money. Even got an email that said the slow period was over. This week? Nothing.

I've been doing this hardcore for the past year with different companies even. I can't take it anymore but MT is all I know how to do, been doing it for almost 20 years.

This job has become more and more difficult/stressful during the past 4 to 5 years -- since outsourcing and voice recognition. I had rather work for less $ any day than get the sloppy dictators/ESL's that the U.S. MT's end up with. Also the doctors whose dictation is not compatible for voice recognition software is being passed on to the MT's.


This job was so fun and exciting about 5 years ago, and I put in MANY extra hours (and made good money) because I did enjoy the job and also the extra money. It seems there is just not enough money offered to pay for the type of dictators/reports that we can get now in this profession. I am probably the only one who feels this way, but I am just being honest.

The IC co. I just left did the same thing. Always responding pretending to be an MT. LOL.

Like I SD - you better believe my pay better be in my acct on the day it is supposed to be there. Not 1-2 days late. You want me ON TIME on the job, you want me to be responsible, give you advance warning of days off, do a quality job, to work the hours I am scheduled. LOL - that goes 2 ways - you better do YOUR job and ON TIME.

U can try discussing it with mgmt but you will just

be discriminated against because u do not think what they do is the best thing since fried grits.  If the program is so wonderful, why all the problems, the notes on the private board about major issues never resolved.  Why does it break down every day?  Why are line counts so hard to get?   Say a word to mgmt about anything and u pay the price by getting nothing but garbage for dictators and garbage accounts.  


They could save a lot of money by trashing this program and starting from scratch cuz MLS could actually produce some work on something decent.

When I applied, Word 2000 and Excel 2000 was the minimum that you needed.. I did ask about the bounced checks, etc and was told that they do not currently have an issue but it was at one time.

My advice - look elsewhere. They (mgmt) is
extremely rude and feedback is insulting.
OMG! That explains it, then. MQ mgmt, and
ex-management are literally scum. After that enlightenment, I wouldn't say I was smart to send MDI-MD packing, but rather my MQ disgust radar was going off, and I didn't know why. Isn't that bizarre? That happened to me at another company a while back - one I was checking out before leaving MQ, and I accidentally recognized one of the names of management on a group email, and inquired. Sure enough, it was a company started by all ex-MQ mgmt. I tried to stay the course, but it was just the same old BS under a different company name. So sad, as I had heard great things about MDI-MD as well. Thus, my willingness to give them a shot. That's really a shame. Lots and lots of MQ MTs left MQ for them as well, and I know not many of us can handle any additional financial hits right now. So sad. People get the courage to leave one monster, and end up in the monster's spawn. Sorry if I offend anyone, but if you know MQ, you can relate.
Mgmt is US based but BAD!!!

Since the US management took over, there is no work and many Focus MTs have either quit - like myself - or have acquired 2nd employers so they make money.  No work, bad management, accounts leaving, payroll always coming up short now, no decent QA, management that won't answer your IMs and if you call team leader you are called stupid, a liar, a worthless retard and basically they hate you and will fire you.  I would personally avoid the company.  It was better and more honest and work flow was great when the Indians managed Focus!

that when I started 2 years ago my very first check was direct deposited, but I can't remember how much time they had to do it.  I DO remember I was shocked, because the company I had come from always told us, it took several pays before it went through.  I think it was because they just didn't bother with the paperwork involved.

Trying every way to cut our pay.   Less and less regular transcription.  Of course, as mgmt says, this is the wave of the future.  But how do we explain that 1/2 cut in pay to our mortgage companies and be able to put gas in our car to go anyway.  Horrible thing happening in this MT field for the MT's.

lol! i'm not mgmt and not scared, just wanted to
share my opinion. I'm just a plain 'ole MT, wouldn't want to be in management or an MTSO. Had a couple of my own local clinic accounts some years back, but one of the doctors went out of business, and I gave the other one to a friend because I was tired of driving 30 minutes one way to pick up tapes and deliver.
