If you do a quick Google search for "apartrments that ban smoking" there are a lot of articles about it. There doesn't seem to be much legislation about it, rather people are letting market forces dictate the situation. Seems landlords are listening to demand from people like the OP and advertising apartment buildings as smoke free buildings.
