General legal matter... maybe somenoe knows

I was wondering if anybody has had this happen to them or someone they know.  I have a problem with neighbors to one side of me who have trumpet vines. These are very invasive and they grow very fast.  When I first moved into my house 10 years ago, they were confined to a very small area along our shared fence.  Now, 10 years later, they are all along the length of the fence, are not being kept trimmed or confined, are reaching the roof of my house, growing inside my garage, behind the washer/dryer, etc.  When I pull them off the side of my house (the side out front where I never go except to wash the windows in the garage once a year) the paint comes off with the leaves, leaving bare spots on the wood.  This is a spot the neighbors can clearly see when they are doing their lawn work.  They sit there and watch the vines grow up the side of my house without even pulling them out, knowing what it does to my paint. 


The roots from the vines are now invading most of my back yard, and they grow about a foot (no joke) a week, so by the time I mow the lawn again, they are way above the height of the grass, sticking out all over.  Now my lawn is ruined, and every year it is just getting worse.  In order to get rid of the vines completely from my yard and property, it will have to be dug up and replaced, and even then it won't do any good because the neighbors have them all over their property and don't care if they have them growing on their roof. 


I have contacted the city, and there is no law on this sort of thing, they told me it would be a civil matter, i.e., small claims court.  I have asked the neighbors countless numbers of times to at least make an effort to keep them contained, and they may cut a little here and there, but a week later, there they are again.  I'm done asking. 


My question is this, has anybody actually gone through with a small claims suit against somebody for this or similar reasons, and what was the outcome?  I have been checking around and it falls under destruction of property and lowering the value of my home.  Thanks for all comments.

Definitely take pictures to use in your defense and when you remove those vines from your house, take pictures of the removal of paint too. Most state laws allow you to control whatever is growing over your house, fence and/or yard that results from a neighbor but if you trim their plants that are on your property and happen to kill the entire tree, plant or vine, your neighbor can make you replace them. It's a matter that has no winning situation because you have to live by these people. I say get a free estimate from a landscaper and get an estimate from a painter also, talk to someone in the legal system and see exactly what your options are, and move forward to bring this problem to an end. Once you find out what action you can take, if any, tell your neighbor what you are planning to do and if they do not take care of the problem, you will move forward as planned. No way would I let this go on without doing something about it. Good luck.

I saw it as a tribute to a soldier in general. 
I can't stand TV in general.

I watch MAYBE 1 hour a week of regular ol' TV and that is just local news blurbs.  I am a big movie fanatic though.


What I really can't stand about the crap coming over the airways is the constant barrage of DRUG ADS--whether they are for prescription drugs or OTC stuff.  It's just too much.


I saw a spot on the news about how stores are contemplating putting in little LCD screens into those "kiddie carts" that the adult can plug $1 into, put the kid in the plastic car/cart thing, so the kid basically can stay numbly tuned into some show while the parents shops in quiet comfort. 


Heaven forbid kids are made to behave while out in public.  Oh don't even get me going on the sheer retardedness of it all...

In general, you're definitely right (sm)
I am not necessarily saying my mom is wrong - but it's not how I am choosing to raise my kids. I don't want them to be scared. I only spank them as a last resort (for defiance after warnings) and they know what lines not to cross. I rarely have to spank them and they are far better behaved than a lot of my friends' children.
Is it because of the neighbors in general
or just that you don't want to impose on anyone? I have 3 that I can borrow from and have. My very best friend who lived across the street up until last year was someone I always went to and vice versa. We could borrow anything from each other and I mean anything. We joke with each other all the time now when I need to borrow something really crazy that I wish she was still here because if I asked the others, they'd think I was nuts.

Someone in my area actually has an ad in the paper that says 'Rent-a-Husband'. For household things like building shelves or cabinets, lighting a pilot light, trapping and removing a mouse in the bathroom, or a bat in the garage, things like that. Petsitting and dog-walking are good options for a rent-a-husband, too! Or for busy people, someone to take their car to the shop for a tuneup and oil change, so they don't have to. Back in the 1970's, during the gas 'shortage', when lines for gas were hours long, people made money by taking people's cars to the gas station and filling up for them.

Maybe he could build those cute wooden children's toys you see at the fancier toy stores. And either sell them or give them to organizations that give toys to needy children. If he's 'artsy-craftsy', maybe he can come up with really cute dog-collars & matching leashes, or cute wooden pet-beds that look like miniatures of the real thing. If he likes to write, and is smart, maybe he could start an advice column for soon-to-be-seniors. (Nowadays 61 isn't really a 'senior' - I think it's closer to 75-80!) Or, if he likes kids, maybe a 'rent-a-grandpa'! Or else maybe a small mail-order business, like on eBay.

Well, that's all for my ideas, I need to get to work, myself!

The one we are talking about right now is a pedophile, as was my granfather. The one I am married to is abusive.

However, I know many men who I love and respect, my stepfather who only lived with my mother for 5 years but has kept in contact with me and my sister all of our lives who I now help take care of. Many other male friends and relatives. My son who I love dearly. I have seen many women post on here and say how fortunate they are to have such a great husband. I can't defend someone who molests children though, sorry.

How legal is this??
I have a worker at my home and he is from another country. He tells me he became a citizen of the US about 3 months ago (he has dual now) but get this- says he wants to retire around 55, move back to his country and then the way he figures, be able to get SS from our country. I guess Uncle Sam figures a way for us all to pay thru the nose!

don't know but sure isn't very nice. What if your mom ends up needing the money if her retirement funds run out? I'll have to read over POA that I have for my mom, think somewhere there might be a note about acting responsibly in handling the funds? So sorry, terrible thing to happen with family and really hard to pursue if you don't have a lot of money to get into a legal battle!
Waking up can happen even with general
anesthesia, happened to me in the middle of a face lift as I was having my neck liposuctioned!! So having general (which I think is more than the conscious) does not mean you stay fully asleep. There are others waking with general, have seen stories on it before on 20/20 I think. I had other surgeries after that time but this was the only time I woke during surgery. I joked with the physician later about my awakening that the anesthesiologist must have gone out for lunch at that particular time!!

I went into the Dollar General looking for school
decorations. I walked out without buying anything.I refuse to patronize a store that does such a dispicable thing. I'm a big halloween fan and was miffed they hadn't even put out the halloween stuff yet!

I'm just always suspicious of "statistics," in general, but particularly so -- sm
when given without the backup data which supposedly generated them. :-) Beyond that, I probably bristled more at the descriptor "filth" as a blanket term covering the categories. I suspect that most of what are considered the greatest movies ever made would not pass that "filth" test.

not anymore. I do not want to pay more taxes and they pay ??? none perhaps to cover them. I pay enough as it is without adding on extra mouths to my taxes.

But I watch gardening shows all the time. There is a special metal barrier you can get that as I recall comes in different sizes, as much as 3' deep, so once you eradicate the vines on your side of the fence you can put the barrier down right along the fence line to keep the vines from growing in your yard again.


You will probably just have to cut the vines that come over on your side of the fence yourself. Obviously the neighbors aren't going to do anything about it.


If it were me, I would get several estimates from local landscaping firms and take these people to small claims court for the amount it would take to fix the problem. Even if you win, I don't know if you will actually get any money from them. It depends on the laws in your state and how responsive the courts are about enforcing their rulings. I really don't know enough to say anything about that.


Again, if it were me, when I was getting the landscaping done, I would tell the landscaper to spray Roundup or whatever kind of herbicide will kill trumpet vines right along the fence and through the slats as much as possible. If it kills the neighbor's trumpet vine, too bad. My heart bleeds.


Am I a mean person? No. But I think people should take responsibility for the messes they make and take care of recitfying them.

It is legal in Nevada and they have to
have medical exams, etc. A lot safer than getting it out on the streets anywhere else.

An OB doctor yes, I am talking about general practitioners or even.....sm
pricey specialists, most do not even cover emergency rooms or in-hospital patients anymore, many hospitals in my area have gone over to a large percentage of "hospitalists", a new specialist who works only in hospital, and when you go into that hospital, the hospitalist stays in close touch with your PCP and records, but is in charge of your care, freeing up the time of the PCP. So much for progressive medicine, what good are all the advances in technology/testing/meds, when the doctors do not take the time or care enough to spend the time with you, without overloading their schedules every day to bring in more $$$, to truly DIAGNOSE THE UNDERLYING PROBLEM CORRECTLY so the proper care is gotten right away. And I am not talking as an MT here, I am speaking as a former LPN, CMA, and office manager, who used to be "ordered" by her physicians to fit in a few more, many times QUADRUPLE booking.....many doctors have just lost compassion, it does not come with the degree!
I'd still hire a local general contractor.

Whether modular or traditional stick-built, there are a million details, legalities and regulations involved - and you'll likely still need some local subcontractors.  A good general contractor can save you a ton of grief and bad experiences.


Take this to a lawyer. Fight for him. This cannot be legal.

And here I do agree with you, which is why I don't want the school to have a legal right (sm)
to teach my child what the teacher personally thinks is right or wrong, but to let me as the parent do that. Yes, they will grow up and decide for themselves, but at that point I will have done what I felt was right.
Is it legal to keep a wild deer as a pet? sm
Someone has had a wild pet deer for a pet in our subdivision for a few years now.  I am a serious animal lover myself, but it has gotten rather old having this deer roaming through the roads and, most of all, eating landscape plants down to nothing.  We have sprayed deer repellent on nearly everything, but the one little area we miss will be chewed right away.  Besides, we have to keep doing it over and over and this stuff is not cheap.  Really getting tiresome.  Do not want to be mean, but what rights do the homeowners in here have??

While I don't remember drugs ever being legal
I do know there was a time in this country where "recreational" drugs were legal. After all, that is where Coca Cola got it's name from (from the cocaine that use to be in it). From what I've read, seems to me there wasn't a problem with drugs in this country until it was made illegal ala prohibition. Now due to it being illegal, there is tons of money flowing in a lot of different directions as a result (the millions of jails that are being build to house all the recreational users, etc. plus the money that is made selling it, etc.). Heck, even though it's illegal, it's big business, so I can see everybody that's involved in it regardless of what side they are on fighting to keep it illegal.

Legit but I would think you have to get a background in legal
because as a scopist you have to go through a court reporters work, basically editing it, don’t know about the pay but you have to be able to work with legal terms. There is a computer program used but if something does not go through on that, then I think you have to revert to using the old way and that would be to read the tapes (like the grocery store tape they used to type on) so I would think school would be in order for this job but it is legit.
