But if the facility is in a country where HIPAA does not apply it still doesn't matter, although they could go through the motions and follow the guidelines for their clients' sakes.


I don't know how a corporation (which is what the offshorers are) operating in another country could be prosecuted if one of their MTs broke confidentiality, but I am sure penalties are in the contract with clients.


As for facilities, a lot of Indian MTs work at home or in cyber cafes.  They are not anymore locked into facilities than US MTs.


I am also not trying to say a US MT is automatically more honest and trustworthy than a foreign one but the threat of being PERSONALLY prosecuted, rather than having your company penalized while you disappear into the night, tends to keep the dishonest at bay.
