If someone wants a link I can provide, but here is basicially what it states.  All I say is thank God there are people like Mr. Berg who are upholding the constitution and doing what is right.  There needs to be a temporary halt until Obama's legitimacy can be proven.  Up until now it has not.

(Lafayette Hill, Pennsylvania – 10/25/08) - Philip J. Berg, Esquire, the Attorney who filed suit against Barack H. Obama challenging Senator Obama’s lack of “qualifications” to serve as President of the United States, announced today that he is immediately appealing the dismissal of his case to the United States Supreme Court. The case is Berg v. Obama, No. 08-cv-04083.

Berg said, "I am totally disappointed by Judge Surrick's decision and, for all citizens of the United States, I am immediately appealing to the U.S. Supreme Court.

This is a question of who has standing to uphold our Constitution. If I don't have standing, if you don't have standing, if your neighbor doesn't have standing to question the eligibility of an individual to be President of the United States - the Commander-in-Chief, the most powerful person in the world - then who does?

So, anyone can just claim to be eligible for congress or the presidency without having their legal status, age or citizenship questioned.


According to Judge Surrick, we the people have no right to police the eligibility requirements under the U.S. Constitution.

What happened to ‘...Government of the people, by the people, for the people,...’ Abraham Lincoln in his Gettysburg Address 1863.

We must legally prevent Obama, the unqualified candidate, from taking the Office of the Presidency of the United States,” Berg said.

Self righteousness isn't appealing....
I do have Muslim friends. My neighbor is Muslim as well. My grown children have Muslims friends they have known a long time. Now, that being said, in talking with my neighbor, they are appalled that others call themselves Muslims and do what they do against this country and others. They are even embarrssed at times for anyone to know they are Muslim and I can understand that. They also have told me that they moved here because Muslims in general in the middle east DO NOT believe we are good people. They have Christians and are not tolerant of them. Though some do not believe in the extremism of bin Laden, there are MANY more that do but they will never admit it out loud because of retaliation by their own.

Now, this proud Americans you mention. Well, my neighbors, even thoug they have been here for three decades, do not call themselves true Americans. And the Muslims they know do not as well. They have been honest that many are here for fear of their lives and the lives of their families but not because they believe America is wonderful, but on the other hand, they say they certainly don't go around telling everyone that. They just wanted a safer place to live and an ability to make a better living but at the same time, would not hesitate to move back to their own country if they felt safer. As the husband told me, he knows many that will lie to the face of many US citizens so as not to have their motives questioned (and he doesn't mean their motives are good). I have spent many hours with them and they have attended our Bible studies, but they are honest that they do believe there was a Jesus, a prophet, etc., but that their laws that are taught to them are not what is taught to us. When asked about the teachings of basically hating Christians, they admit that is true and that basically in order to live in this country, they are more tolerant than anything.

So don't be fooled by everything you hear. I am devout in my faith as well but my faith does not tell me to go out and slaughter Muslims, as in the Muslim belief of Christians.

I'm thanking God for Mr. Berg
who is standing up to defend the constitution. And no judge should be allowed to throw out a case based on political affiliation. Especially when the judge only signed a piece of paper faxed to him - a question on a lot of minds is "where was this fax from".

The Constitution of the United States is a document that outlines the basis of the federal (national) government of the USA. It was written in 1787 at the "Constitutional Convention," held in Philadelphia, Pennsylvania, in what we now call Independence Hall. The 55 men at the convention are called the "Founding Fathers" of the USA, and are also known as the "Framers of the Constitution." Some of the more famous of the framers are George Washington (the first President of the USA), James Madison (the fourth President of the USA), Benjamin Franklin, and Alexander Hamilton.

"We the People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defense, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America."

“We” the people, are heading to a “Constitutional Crisis” if this case is not resolved forthwith.

I think God people like Mr. Berg is proceeding to protect our rights.

Phil Berg for Hillary?
Philip Berg is/was an avid Hillary Clinton supporter and filed his motions before the Democratic Convention, didn't he? Besides, the court has not made any demands on Obama to produce anything. He released his birth certificate and the Hawaiian birth announcement, nothing more is required.

Also if you check Obama's official website, you'll see that Michelle Obama has a busy campaigning schedule while her husband is in Hawaii. I don't know, but I don't think it's too strange to think that she may have felt it was important to continue campaigning during his absence at such a crucial time.
This proves that Phil Berg is a hardhead who
twice failed legal action. So you still have presented nothing that back up your claim that this is still on the docket. By the way, ever heard of frivolous lawsuits. They are not confined to medical malpractice, dontcha know?

IF he were able to prove (a) that Obama was born in Kenya, (b) that he was an Indonesian citizen whose mother had "renounced" (NOT) his US citizenship, and/or (c) that Obama's HAWAIIAN birth certificate was a forgery...don't you think that a complaint based on "standing," "harm" and/or "disenfranchisement" is a rather convoluted, roundabout way of "getting to the truth?" That burden of proof would be on him and he could not do it because, well...IT ISN'T TRUE

The judge has ruled. If a 34-page rendering is not enough to satisfy you, then Lord knows, there is no reasoning with this pathologic degree of denial. IT'S OVER. Finito. Kaput. Settled. Gone. There's NOTHING there. Period. The end. Time to let it go, already.

Judge rejects Montco lawyer's bid to have Obama removed from ballot

A federal judge in Philadelphia last night threw out a complaint by a Montgomery County lawyer who claimed that Democratic presidential candidate Barack Obama was not qualified to be president and that his name should be removed from the Nov. 4 ballot.

Philip J. Berg alleged in a complaint filed in federal district court on Aug. 21 against Obama, the Democratic National Committee and the Federal Election Commission, that Obama was born in Mombasa, Kenya.

Berg claimed that the Democratic presidential standardbearer is not even an American citizen but a citizen of Indonesia and therefore ineligible to be president.

He alleged that if Obama was permitted to run for president and subsequently found to be ineligible, he and other voters would be disenfranchised.

U.S. District Judge R. Barclay Surrick had denied Berg's request for a temporary restraining order on Aug. 22 but had not ruled on the merits of the suit until yesterday.

Obama and the Democratic National Committee had asked Surrick to dismiss Berg's complaint in a court filing on Sept. 24.

They said that Berg's claims were "ridiculous" and "patently false," that Berg had "no standing" to challenge the qualifications of a candidate for president because he had not shown the requisite harm to himself.

Surrick agreed.

In a 34-page memorandum and opinion, the judge said Berg's allegations of harm were "too vague and too attenuated" to confer standing on him or any other voters.

Surrick ruled that Berg's attempts to use certain laws to gain standing to pursue his claim that Obama was not a natural-born citizen were "frivolous and not worthy of discussion."

The judge also said the harm Berg alleged did "not constitute an injury in fact" and Berg's arguments to the contrary "ventured into the unreasonable."

For example, Berg had claimed that Obama's nomination deprived citizens of voting for Sen. Hillary Clinton in November. (Berg backed Clinton in the primaries.)

Berg could not be reached for comment last night.

Obama was born in Honolulu on Aug. 4, 1961, and the campaign posted a document issued by Hawaii on its Web site, fight thesmears.com, confirming his birth there.

Berg said in court papers that the image was a forgery.

The nonpartisan Web site FactCheck.org examined the original document and said it was legitimate.

Further, a birth announcement in the Aug. 13, 1961, Honolulu Advertiser listed Obama's birth there on Aug. 4.

I consider the people..
and programs I mentioned fair and balanced. Meet the Press, Hardball, Tyler Carlson on CNN, Face The Nation. They said that they would not accept Drudge as reliable information, not I although I don't but my opinion carries less weight than that of those mentioned above.

My husband has been saying that same thing for the past few years. I am so sick and tired of working so hard to make a good life for my family, only to have *big government* take half of my money to give to people who won't lift a finger and want government to take care of them. It just makes me sick! I don't know why so many people are so blind to this.

Politicians are the only people in the world who create problems and then campaign against them.

Have you ever wondered why, if both the Democrats and the Republicans are against deficits, we have deficits?

Have you ever wondered why, if all the politicians are against inflation and high taxes, we have inflation and high taxes?

You and I don't propose a federal budget.  The president does.


You and I don't have the Constitutional authority to vote on appropriations.

The House of Representatives does.

You and I don't write the tax code, Congress does.

You and I don't set fiscal policy, Congress does.

You and I don't control monetary policy, the Federal Reserve Bank does.

One hundred senators, 435 congressmen, one president, nine Supreme Court justices = 545 human beings out of the 300 million who are directly, legally, morally, and individually responsible for the domestic problems that plague this country.

I excluded the members of the Federal Reserve Board because that problem was created by the Congress.   In 1913, Congress delegated its Constitutional duty to provide a sound currency to a federally chartered, but private, central bank.

I excluded all the special interests and lobbyists for a sound reason.
They have no legal authority.   They have no authority to coerce a senator, a congressman, or a president to do one cotton-picking thing.   I don't care if they offer a politician $1 million dollars in cash.   The politician has the power to accept or reject it.   No matter what the lobbyist promises, it is the legislator's responsibility to determine how he votes.

Those 545 human beings spend much of their energy convincing you that what they did is not their fault.   They cooperate in this common con regardless of party.

What separates a politician from a normal human being is an excessive amount of gall.   No normal human being would have the gall of a Speaker, who stood up and criticized the President for creating deficits.   The president can only propose a budget.   He cannot force the Congress to accept it.

The Constitution, (supposedly) the supreme law of the land, gives sole responsibility to the House of Representatives for originating and approving
appropriations and taxes.   Who is the speaker of the House?   She or he is the leader of the majority party.   She or he and fellow House members, not the
president, can approve any budget they want.   If the president vetoes it, they can pass it over his veto if they agree to.

It seems inconceivable to me that a nation of 300 million can not replace 545 people who stand convicted -- by present facts -- of incompetence and
irresponsibility.   I can't think of a single domestic problem that is not traceable directly to those 545 people.   When you fully grasp the plain truth that 545 people exercise the power of the federal government, then it must follow that what exists is what they want to exist.

If the tax code is unfair, it's because they want it unfair.

If the budget is in the red, it's because they want it in the red.

If the Marines are in  IRAQ , it's because they want them in  IRAQ .

If they do not receive Social Security but are on an elite retirement plan not available to the people, it's be cause they want it that way.
There are no insoluble government problems.

Do not let these 545 people shift the blame to bureaucrats, whom they hire and whose jobs they can abolish; to lobbyists, whose gifts and advice they
can reject; to regulators, to whom they give the power to regulate and from whom they can take this power.   Above all, do not let them con you into the belief that there exists disembodied mystical forces like 'the economy,' 'inflation,' or 'politics' that prevent them from doing what they take an oath to do.

Those 545 people, and they alone, are responsible.

They, and they alone, have the power.

They, and they alone, should be held accountable by the people who are their bosses,  provided the voters have the gumption to manage their own employees.

I want to know why people like
Dodd and Frank aren't being held accountable?  Why aren't the CEOs being held accountable?  It thoroughly ticks me off that this is literally being swept under the rug.  I want to see some punishment here. It is like they all got a get out of jail free card or something.  WTH?  They all lined their pockets with money and we are the ones paying for it and suffering.  People walking away with millions of dollars with no consequences at all while we are left to pay for their misdeeds.  I'm totally disgusted!  I say we clean house and start all over with new people.  I wanna show these politicians that I'm tired of being screwed over by them.  I really feel like this bailout was the rich bailing out their rich friends.

Don't underestimate Gov. Sarah Palin. She knows more than people give her credit for and she's smart as a whip. Looking forward to the debate.

As for McCain's heath, I wouldn't weigh too heavily on that. He's been cleared of cancer now for at least 7 years by his doctor and is cancer-free. To be worried about that would be the same if something was to happen to Barack or Biden - would you really trust Pelosi as president? That would be too laughable if it weren't so scary. I would say if you agree with McCains policies (which I believe are going to be better for the country than Barack Osocialist's policies) then vote for him. Also remember. There are people who direct every president. There has never been any president who has ever done anything without the approval of their bosses. At least John McCain and Gov Palin will be surrounding themselves with the people who know what's going on and how to handle whatever situation arises with better solutions than the people who Obama would surround himself with. I trust that more than anything.

I wish more people were like you
Then the need for welfare would be obsolete.

In our backwards town the people you are reporting to are more than likely relatives of those on welfare! I've brought it up a few times to officials, but nothing ever gets done. They basically say "mine your own business" well it is my business if it's MY tax dollars.

I'm glad to hear things are working out for you now. We aren't very high on the hog either, about at his ankles I would say :) but we get by, and we reach out to those we can. I love our church because they reach out a lot and I've seen at least five people come in who never attended our church and no one at our church knew, and I've watched members hand them money, knowing they would probably never see them or it again. I've watched our preacher take the money from the offering plate and hand it to them. Which is what a church should do. Now maybe those people weren't nothing but drug addicts or alcoholics, but people gave freely, and that's the difference. No one should be forced to give to those less fortunate. That just breeds animosity and class warfare.

I like to give most people the benefit of the doubt, and I tend to trust in people as a whole, but the more I get burnt, the more trust I lose in society as a whole. I'm learning to look at people with a more critical eye, and I don't know if that is a good thing. But after all the abuse of the system I have seen in my town and the towns surrounding, it just makes me really against giving anymore into the welfare system. Not without a total revamping of it. But, we are forced to, so I guess I will! :)

they hear.  This is just now "coming out."  Doesn't that tell you something?  Two days before election?  Show me where he said it on VIDEO  tape that is reported on the news..  Don't give me this audio stuff.  I don't care if you support McCain but for God's sake, don't be going off on witch hunts.

seriously, if you cast your ballot ahead of time and then you die for the election, does your vote still count?  I'm just wondering if she already submitted her vote, because if so, I think it shouldn't be counted.

It is sad that some people can't
get past the us versus them mentality, and it's not just with politics.
Not what most people want to see BUT
Let's face it, most of us are having turkey for Thanksgiving and I, for one, don't believe my turkey dinner died of natural causes.

These are some of the same people whose
mortgage we are probably all going to be paying for. The normal, civilized people in our group of friends don't worry about having to stand in line to save a few bucks on something everybody else has already.
and most people think he should be doing more -
what gives? Nobody can be satisfied. If he does not say or do anything, then he is wrong, if he says something, he is wrong!!!

I don't understand why everybody just wants to complain all the time...
