Anyone filed a complaint after not receiving a paycheck? sm

Stopped working at Breitner 3 months ago.  I never received my last paycheck, and the one before that was short by $100.  They owe me about $1,000 total.  I am not counting the 30% trimmed off my line counts for 8 straight weeks in Extext to cover headers and footers when it really only equals 5 to 8 lines.  Has anyone ever filed with the labor board on them?  Just asking because I have read posts on here that they threaten & just want to see what I am in for if I do file.

I think we all should go online and fill out the complaint form and mail it in along with a copy of all the complaints on this site.  I would love to see that disrespectful SOB do some jail time.

I had a great saving account this time last year when the company I had been with 2 years took me off my primary (never would tell me why, just said me being shut out was a glitch in the hospital's system) floated me around (not telling me anything of course) because they were getting a Meditech account and wanted me on it (you wouldn't put someone not very experienced on it would you?). It did not take a rocket scientist to realize as soon as I got the C-phone what had happened. Also 80% ESLs. I spent the whole year supplementing my salary until it was gone and have been trying to find a decent company since. That is why I am living paycheck to paycheck and I hate it. I have 20 years in this business and it is getting worse. Speech is great but not for the money. It just does not justify being paid half. You cannot retrain doctors and I don't think management telling them they need to be considerate to us is going to work. Telling them we are making half just does not move them. They still rumble through files, change sentences, have long pauses we are not paid for, speech leaves out words or sentences so tell me why we are paid half? Also, I usually seach a company before I come on and ask for opinions, it saves a lot of space. I know I sound grouchy but I am tired and scared.

Personally, I live paycheck to paycheck because...
I enjoy the constant worry about how to pay my bills and always getting to say I have some lines to make up so I won't be there. Social lives are overrated. I like getting up at 3:00 a.m. and jumping online so I can wrestle a few more jobs out of the system. I don't mind hearing that my supervisor is on vacation again because I know I will be able to use my PTO to make up for my downtime. It's kind of the same thing. I think Ramen noodles aren't just for college students, and one pair of jeans is all you really need for 3 years. I believe very strongly that all the recruiters and managers in the transcription business are taking wage cuts every year, too, so I don't want to feel like I am asking for more than my share.

Exactly. Its the mind-set of the MT on the receiving
end for how corrections or feedback or anything is accepted. I have found the newer MTs to most often have a wonderful spirit - they appreciate any sort of feedback and thus learn and grow from it, as is the proper course of events. But there are older MTs who are stuck in their rut - they've been typing something wrong for 35 years and by gosh, that affirms to them that it was right. They don't accept anything - feedback, correction, suggestions no matter how sweet the delivery - its kill the messenger with the message. Also there are newer MTs in the industry who just don't have a professional attitude - they churn out garbage and could care less. Probably the ones who took their courses from a matchbook advertisement. They have enough - skills - to get their foot in a door of a desperate national, but not an ounce of professionalism, so again no matter how a correction is delivered, QA is the enemy. Sadly, the #s of hateful MTs versus grateful MTs is way off balance, and the companies don't say boo for fear of losing the warm bodies typing - quality does not matter - its quantity. I am so much happier transcribing.

and sent copies of some of these job ads asking for ICs and listing a shift.  I am fed up and sick and tired of this.


I have realized after receiving my paystub
that MW pays you want they want to. Once again, this is under the new pay structure for Merit editors.  I have no idea why I took the time to do a time sheet.

I am an IC.  I expect nothing.  The one online MTSO I work for is my client.  End of story.  My other two accounts are my clients as well.  They are not my employer; none of them.


For those of you who are actually employed and are not ICs, maybe you would expect something.  But in my opinion Christmas is about giving and not expecting to receive.

Who is receiving Third-World wages...
Really?  I certainly am not.  I have never made less than $20 an hour as an MT.  If you are making Third-World wages, it is time for you to find a different job.  There are plenty of good opportunities out there.
filed for partial unemployment

I don't know completely your situation, but a few years ago, I filed for partial unemployment while employed at a service b/c the workload was extremely sparse and did receive it.  When I filed, I also went looking for a new job and found one within a month. 


My suggestion like others is to start looking now for a new job, but if the workload is low, you could possibly get partial unemployment now until a new job is found.  Every state is different, so you would have to check with the unemployment office in your state regarding benefits, insurance, etc.  Good luck in your search!


I "thought" that if you filed in your jurisdiction
naming her jurisdiction as the jurisdiction that handled it that courts would send it to that jurisdiction and have them handle it. It seems I did that once, but I could be wrong. I sure would not want to tell her wrong.

Anyhow, it is still possible to do that and not have to leave the house other than to get that paperwork to the proper court. Do not let her get away with it.

Update - saw my attorney and filed for

Two people at the unemployment office told me I have every right to claim unemployment.  My attorney looked over my contract and apparently the owner didn't cover all her avenues and he found a loophole and told me to file.  BTW - one of the ladies at the unemployment office told me they are seeing more and more MTs filing. 


I have never heard of one person actually RECEIVING the bonus
to reel unsuspecting suckers in. Don't fall for it. It's never happened and it never will.
I have rec'd an offer and am receiving software install in the next day or so. SM
So far, I'm very impressed, and they are very nice.  The cpl could, of course, be higher.....but then again, I always think that of every company I talk to.  They do have a shift differential, and I'm going to be working in the evenings.  We'll see how it goes, but I'm looking forward to it so far.  I just sent in a resume out of nowhere, and it did take a couple of weeks for them to get back to me.  From the point I answered back, however, it will have taken 4 days from test to install. 
once filed, both parties must appear at small claims
court. If party that didn't pay doesn't show, then a judgment will be made against them. If the person filing the complaint in small claims doesn't show, it will be thrown out.
I got mine almost a week ago and already filed. You might want to call them.

Has anyone filed bankruptcy, had a credit report
I give up :(.  I'm going to file bankruptcy but I'm concerned I won't be employable after that with another MTSO (or any other company; they almost all require credit reports these days).

I keep mine filed per year with my taxes.
In the event of an audit, I believe they can go back 7 years.
P.S. - If your company has filed form SS-8 ask for a copy.
If they won't give it to you, see if you can get it from the IRS; I believe you can.

And, of course you can still file your own SS-8 even if the company has filed it. I'm not saying an MTSO would LIE on the form they file, but anyone can make a MISTAKE...
help receiving encrypted files through Express Scribe

Is there anyone out there who could tell me how I could listen to encrypted files in my Express Scribe which I receive through email???  I am able to receive and listen to them just fine when not encrypted, but cannot figure out how to set ES up to use a password.  When I click on the voice file in my inbox, it now takes me to ES, but displays an ERROR box stating  - unable to open DSS file, this means the file might not be a true DSS file or the file is corrupt


The files are coming from a dss program called Olympus if that matters.  Any insight would be greaaaatly appreciated!!!

I didn't receive it today, so even if I get it tomorrow, that means funds will not be reieased until Monday, meaning no pay day until Tuesday, and possibly Wednesday.  I am a bit fed up with not having a reliable pay day I can count on.  I will be leaving soon, but in the meantime, I still have bills to pay. 


Sorry ... guess I just needed to vent.

I don't know why, but I remember a few years ago that they added a fee to place a complaint - at least in Texas.

You can file a complaint with the
distrinct attorney in the city in which they are located and this should put an end to this nonsense.  Rubber checks are illegal all over the country.  Then file a case in small claim court and include ALL expenses you incurred from late charges, etc., as a result of this check 
How do you file a complaint in CA?
Who would you file a complaint with if the company who is not paying is in California? The California Labor Board, Attorney General's office, and Better Business Bureau?

a lot of time filling in demos. I tried it for about 6 months, but I just could not seem to up my count whatsoever due to that. I will say I never had any ESL docs.
file a complaint with the
Better Business Bureau in your area as well as the area the owner of the MT company lives.  This does not take but a few minutes of your time.  Consider calling the police to ask what can do?  It is illegal to bounce checks........ Good luck!
another way to post complaint...
against those companies that steal our services by not paying or paying with bad checks etc. Like D&L in PA. All corporations file with Dunn and Bradstreet - they assist these small companies grow their business - send them an e-mail informing them of the companies practice so it goes in their files - anyone searching them out for business should know how they treat their independent contractors and employees. If all credit reporting agencies can do this - why not the people actually getting shafted.

If you only complaint is QA telling you something different, then show them !!
However, you said the account was too difficult for you. So, I assumed you could not handle it. If the QA dept is incorrect, point it out to them and show them where they are giving you wrong info. Simple as that, if that is really all it is.

it is nice to get the information you need as an MT, and some places give you nothing, but it was an incredible amount of books, I've never gotten that many before,and I truly did not have room for them all, not a complaint, just a statement.
My only real complaint is that the medical ins
has really deteriorated this year. There is always lots of work and they are good about giving PTO at least my supervisor is. Sometimes I have to jump around to different accounts but they are the same accounts all the time so I can pretty much get used to them. Hope that helps you.

Dictators who don't know what a Chief Complaint is. (sm)
Here are some chief complaints: Chest pain. Shortness of breath. Back pain. Type that and now you have some context and you're ready for the history of present illness. But so many dictators want to include all sorts of patient information, like age and details of what happened. That is not a chief complaint guys. Comprehend the headings and let them help you save time! Grrrr.

I did file an SS8 complaint and you are correct - snm

Yes, you will have to refile your taxes if you are found to be a an employee and not an IC.  You will not be assessed penalties and interest on anything you may owe.  Remember some of the things you deduct as an IC are no longer deductible or fully deductible as an employee.  Your employer will be hit with back taxes, pentalties and interest. 


I've heard people say the won a huge amount of money when they did this and you know what, they are lying.  The company will not owe you anything directly.  Any changes that take place are between you and the IRS and the company and the IRS.  There really are no winners.


Depending on  your tax situation, you may owe or you may get some money back.  In my case, I broken even, but I had some extenuating tax circumstances.  I had to deal with an IRS rep and I was panicked because for one year I owed a huge chunk of change and for another they owed and I was afraid that I was going to have to pay up to get back if you know what I mean.  This is the IRS afterall, but after final review and analysis with the IRS rep, we just called it even (even though it was not exactly so) and the IRS signed off on it. 


Was a huge eye opener for me  The entire process probably took 18 months from the time I filed my complaint.

Shortage of work has been a MAJOR complaint....
with all 4 MTs that I know who work at MDI.  We are all trying to stay loyal to them, but it seems as though no one is listening and they just keep hiring!!  If you have work, you should be counting your blessings, but it is only fair to let those people seeking employment at MDI to know what a lot of us are experiencing. 
File a Complaint with Labor Board
File a complaint with labor board in their state and familiarize yourself with the complaint form for retaliation in case they try to penalize you.
