My concern in what would be considered in a late-term abortion would be mainly the health of the mother.  If the physician were found to be intentionally endangering the mother by doing a late-term abortion then, yes, that would be a problem.  But that would be no different than any other malpractice suit.  The same would apply if the child was viable and no attempts were made to save it.  I think those would be the only circumstances applicable for legal action.  As the law stands now, if there is a pregnant lady who is 9 months along and she decides to jump off a table and looses the baby, we don't prosecute her for murder, so what would be the difference between that and having a late-term abortion as far as legal action against the mother goes?
